,t- '-.

2

Upon completion of the project, please submit "as-built" plans, certified by
a registered professional engineer, of all proposed project elements.

Please note that in accordance with Section 65.12(b) of the National Flood
Insurance Program (NFIP) regulations, your community, prior to approving the
proposed encroachments, must provide evidence to us of the adoption of
floodplain management ordinances incorporating the increased BFEs and revised
floodway reflecting the post-project condition.

A LOMR will not be issued at this time to reflect the new "existing"
conditions. We will make a final determination on revising the FIRM by
either a Letter of Map Revision or Physical Map Revision upon receipt of
"as-built" plans, and data required for Section 65.12(b) described above.

The basis of this CLOMR is, in part, a proposed channel modification project.
NFIP regulations, as cited in Paragraph 60.3(b)(7), require that communities
"assure that the flood-carrying capacity within the altered or relocated
portion of any watercourse is maintained."

This provlslon is incorporated into your community's existing floodplain
management regulations. Consequently, upon completion of this proposed
project, the ultimate responsibility for maintenance of the channel
modification will rest with your community.

If you have any questions, please call Mrs. Cynthia M. Croxdale of my staff
in Washington, D.C., at (202) 646-3458.

Sincerely,

w~.~?,~

William R.
