<br />. <br /> <br />J. Appeals. An applicant for a floodplain development permit or any <br />persons claiming to be affected by the granting or denial of any <br />such permit may appeal such granting or denial. Anyone wishing to <br />request change to or rejection of the Official Maps and the base <br />flood elevation. or any part thereof, may appeal the maps. Appeals <br />shall be filed with the Administrator. and engineering and <br />technical data shall be furnished to support the appeal. After <br />the engineering and technical data have been reviewed by the <br />Administrator, the Colorado Water Conservation Board and the <br />Federal Emergency Management Agency and found to be accurate, the <br />Official Map and base flood elevations will be amended and <br />redesignated by the Colorado Water Conservation Board. Appeals <br />that are denied by the Administrator may be brought to the Planning <br />Commission within thirty (30) days of the granting or denial of <br />such permit. <br /> <br />97-9. Enforcement; violations and penalties. <br /> <br />A. The Administrator is hereby empowered and directed to inspect and <br />examine the use, occupation or development of floodplains subject <br />to these regulations for the purpose of determining from time to <br />time whether any use, occupation, development or activity is in <br />violation of any of the provisions of these regulations or any <br />permit issued or required pursuant to these or other applicable <br />regulations, <br /> <br />B. Prior to the issuance of a certificate of occupancy or a <br />certificate of zoning compliance, the structure is to be inspected <br />to assure that it was built in full compliance with the applicable <br />floodplain management requirements. In addition, the Frisco <br />Building Official is to require that the applicant obtain a <br />certificate from a registered professional or licensed land <br />surveyor, licensed in the State of Colorado, indicating the <br />as-buil t elevation of the lowes t floo r of any building or the <br />as-built floodproofed elevation of any floodproofed nonresidential <br />structure located in the floodplain, <br /> <br />C. If a violation of these requirements is found to exist, for any <br />land use, in accordance with the provisions of Subsection D below, <br />the Administrator shall by written order direct that remedial <br />action be taken immediately to result in full compliance of that <br />land use with the applicable provisions of these regulations. <br />However, the issuance of such order shall in no way or manner be <br />enforcement proceedings as are set forth in these regulations; and <br />provided, further, that compliance with such order shall not <br />necessarily be deemed to be a defense to any alleged violation of <br />these regulations in any court action instituted seeking full <br />compliance therewith. <br /> <br />D. Violations and remedial actions. <br /> <br />(1) It is unlawful to erect, construct, reconstruct, alter, <br />maintain or use any building or structure or to use any land <br />in violation of these regulations, Any violation of these <br />regulations is punishable by a fine or imprisonment as <br />provided by Sections 30-28-124 and 31-16-101, Colorado <br />Revised Statutes. <br /> <br />Page 20 <br />
