<br />by the Federal Emergency Management Agency, and said report was approved and <br />designated by Colorado Water Conservation Board Resolution No. 92-319 on March 5, 1992, e <br />at the request of the City of Arvada, Colorado; and <br /> <br />WHEREAS, said Wright Water Engineers report is consistent with the Federal <br />Emergency Management Agency report designated by Resolution No. 92-319 for those areas <br />within the City of Arvada; and ' " <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the <br />Colorado Water Conservation Board to assist in the prevention of floods and flood damages <br />therefrom; and <br /> <br />WHEREAS, Section37-60-106(1)( c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels <br />or basins and to make such designations available to legislative bodies of local jurisdictions; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that such legislative bodies of local jurisdictions may provide zoning regulations for land uses <br />on or along any storm or floodwater runoff channel or basin only after designation and <br />approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, the staff of the Board bas reviewed said report and finds that it meets .. <br />all the applicable requirements for designation as detailed floodplain information under the .. <br />Board's "Rules and Regulations for the Designation and Approval of Floodplains and of <br />Storm or Floodwater Runoff Channels in Colorado" (1 CCR 408-1). <br /> <br />NOW, TIIEREFORE, BE IT RESOLVED by the Colorado Water Conservation <br />Board in regular meeting assembled in Denver, Colorado, this 8th day of May, 1992, that <br />it does hereby designate and approve as detailed floodplain information the 100-year <br />floodplain as described by the floodwater surface elevations and profiles in said new report <br />for the stated study reach of Van Bibber Creek, and does hereby rescind that portion of <br />Resolution No. 72 for the study reach of Van Bibber Creek from its confluence with Ralston <br />Creek upstream to Indiana Street, and specifically does not rescind any portion of <br />Resolution No. 92-319; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send <br />a certified copy of this resolution to the City of Arvada, the Board of County Commissioners <br />of Jefferson County, the Urban Drainage and Flood Control District, the Colorado Office <br />of Emergency Management, and the Federal Emergency Management Agency. <br /> <br />2 <br /> <br />e <br />
