Failure of the State to accomplish the objectives set forth in agreed upon <br />statements of work in the Program Narrative may subject the State to the with- <br />holding of funds provided under this Agreement, or to collection of such funds <br />already expended, not to exceed the estimated cost of work not performed, as <br />determined by the Regional Director. <br /> <br />C. Failure of the State to accomplish the objectives set forth in its statements <br />of work for the previous fiscal year may subject the State to a diminished <br />or withheld award of funds provided under this agreement, as determined by <br />the Regional Director. That is, award of funds under this CCA is contingent <br />upon successful completion of the previous year's CCA work. As a principle, <br />a recipient earns renewed stewardship of Federal funding by successfully <br />completing previous stewardship assignments. <br /> <br />D. Any funds which become available to FEMA from the imposition of sanctions <br />to withdraw money from an already awarded CCA or withhold money from a CCA not <br />yet awarded revert to FEMA headquarters. <br /> <br />Article Xl. General FEMA Administrative/Regulatory Provisions <br /> <br />The State, for itself and any subgrantees, and FEMA agree to carry out program, <br />administrative, and fiscal aspects of this Agreement in accordance with the <br />policies and procedures in the Comprehensive Cooperative Agreement Policies <br />and Procedures Guide, CPG 1-38; FEMA Financial Assistance Guidelines, CPG 1-32; <br />CCA General Program Guidelines, CPG 1-3; and Administrative Guidelines for <br />FEMA Assistance Programs, FEMA Manual 2100.2. Documents of legal efficacy <br />as specified in the Annual Program Requirements are .hereby incorporated by <br />reference to the applicable programs. <br /> <br />Article XII. Amendments <br /> <br />,~ <br /> <br />A. State-initiated changes in the Agreement shall be submitted in accordance <br />with CPG 1-32, FEMA Financial Guidelines, and CPG 1-38, Comprehensive Cooperative <br />Policies and Procedures Guide. An approved statement of work may be updated <br />or revised within the general scope of the pertinent Annual Program Requirements <br />Annex by submitting an amended version, along with written justification, to <br />the regional office as a request. In addition, proposed changes to the <br />budget must be submitted as a revision of the data on the Budget Information <br />forms used for the original budget estimate (Part III of SF-424). The FEMA <br />Signatory Official will use the FEMA Form 76-10, Assistance Award/Amendment, <br />to offer proposed amendments to the State or to notify the State of approval <br />of a State-initiated amendment. The FEMA Form 76-10 will also be used to <br />record and report all funding actions pertaining to the Agreement, and will <br />provide a summary of the status of funding as of the date of the most recent <br />funding action. <br /> <br />B. FEMA reserves the right to deob1igate funds already made available to the <br />recipient through this instrument. This is necessitated by the potential of <br />Federal funding cutbacks required by Federal deficit reduction legislation. <br />All other remedies, however, will be exhausted before such deob1igation is used. <br />
