Emergency Use of Resources <br /> <br />In accordance with the objective of this Agreement to enhance State emergency <br />management, including emergency response capability, any personnel, supplies, <br />equipment, and facilities funded in whole or in part within this Agreement may <br />be employed in emergency operations in connection with natural disasters, without <br />change In funding among programs, subject to the following conditions: <br /> <br />A. Such use shall not detract from, nor be allowed to prevent, accomplishment <br />of the objectives set forth in the statement of work for the program activity <br />under which those resources are funded. <br /> <br />B. The primary use of any resource funded under this Agreement shall be to <br />accomplish the objectives of the program activity under which it is funded. <br /> <br />C. The temporary reassignment of personnel otherwise authorized by this Agreement <br />must he justifiable because of an urgent need for staff or due to the occurrence <br />of a disaster as defined in Section 3 (Definitions) of the Federal Civil Defense <br />Act of 1950. <br /> <br />D. Expenses above the ordinary salary or normal program expense to support the <br />resource (e.g., travel, per diem, etc.) must be payed by the emergency activity <br />to which the resource is temporarily assigned. <br /> <br />E. .No individual shall be hired or other resources acquired under this Agreement <br />for the sol e or prine i pa.1 purpose of use in an emergency or di saster. <br /> <br />F. No emergency use of staff shall exceed, in the aggregate, 15 calendar days <br />per person without prior approval of the FEMA Regional Director. <br /> <br />G. An accounting audit trail must be maintained .for any such use of resources. <br /> <br />H. In the event the recipient fails to comply with paragraphs A. through G. <br />above, the Regional Director shall have the right to require that use of those <br />resources be compensated by non-FEMA sources or to disallow such use of funds. <br /> <br />Article X. Nonperformance <br /> <br />A. In' keeping with the concept of integrated emergency management and civil <br />defense, a State is expected to participate in all programs for which funding <br />Is offered, unless extenuating circumstances warrant exclusion of a program <br />or programs. Refusal of a State to participate in nuclear attack preparedness <br />programs and activities or lack of accomplishment of objectives supporting <br />these activities will constitute reason for withholding or withdrawal of civil <br />defense funding, as determined by the Regional Director and the Director of FEMA. <br />
