<br />?Compensation and Methow'payment. . <br /> <br />This MOA is subject to and contingent upon the continuing availability offederal funds for the <br />purposes hereof. OEM will notifY CWCB immediately upon any permanent or actual <br />reduction of federal monies which would reduce the amount and scope of this agreement. A <br />written amendment will be processed as soon as possible thereafter. <br /> <br />OEM will advance the entire federal portion ($139,l08) promptly upon receipt ofa formal <br />invoice and a CWCB initiated IT document (COFRS). <br /> <br />The Colorado Water Conservation Board shall: <br /> <br />Provide the services described herein on a total budget of $185,477.00. <br /> <br />a. $139,l08.00 - Federal funding (75% of the budget) and <br /> <br />b. $ 46,369.00 - In-kind or cash match; funding from existing ongoing CWCB <br />functions (25% of the total budget). Reduction of federal funds will proportionally <br />reduce the required match funding. <br /> <br />Payment for the accomplishment of project tasks by the CWCB and sub-grantees will be <br />accomplished on a monthly basis by the Colorado Department of Natural Resources in <br />amounts not to exceed transfers offunds by OEM <br /> <br />3. Time of Performance. <br /> <br />Upon execution, this Memorandum of Agreement shall be in effect from December l, 1997, <br />through November 30, 1998, unless changed in writing with the concurrence of the original <br />parties. It is understood that the effective date of this MOA is prior to its execution. Eligible <br />expenses may have been incurred prior to the execution of this MOA and may be considered <br />eligible expenses toward completion of the MOA projects. <br /> <br />4. RlWortinS ReQ)1irements. <br /> <br />CWCB will submit to OEM Biannual Performance Reports no later than 4/20/98 <br />and l0120/98. The Biannual Report and documentation will be incorporated in the <br />State Project Manager's Quarterly Report. FEMA form #2O-l0, the Fmancial Status <br />Report, must be submitted on a quarterly basis to be included in the OEM quarterly <br />FEMA report; and is due by the 20th day after the end of each calendar quarter. <br />(FFY98 lst qtr. 1/20/98, 2nd qtr. 4/20/98, 3rd qtr. 7120198, 4th qtr. l0120/98 and <br />1st qtr. FFY99 1/20199). Each financial status report shall include documentation <br />for the federal funds expended and the 25% state in-kind match of the federal funds. <br /> <br />5. General Provisions. <br /> <br />The State, the Comptroller General of the United States, or any of their duly authorized <br />representatives shall have access to any books, records, etc. relating to the expenditures of <br />funds under this Memorandum of Agreement. <br /> <br />Pogc 2 of3 I'agcs <br />
