<br />Local governments which are concerned about the possibility of <br />legal action allainst floodplain regulations they adopt should be <br />aware of legal precepts which have evolved from past court cases <br />debating zoning and other related questions. <br />1) Regulations and State statutes enabling them, including flood- <br />plain regulations and enabling statutes, are presumed to be con. <br />stitutional when they are enacted. <br />2) The individual chalienging the regulations must show that a tak- <br />ing has occurred or that statutory procedures have not been <br />foliowed. <br />3) Creation of a nuisance or of a threat to public safety has not <br />been recognized as a right of property owners. <br />4) Properties within a fioodplain delineated by accepted engineer' <br />ing methods are already burdened by natural restrictions without <br />even considering zoning restrictions. <br />5) Even if it severely limits the individual, a regulation that prevents <br />potential threats of injury and loss to the public is likely to be upheld, <br />6) The "pinpoint" approach means that the constitutionality of <br />floodplain regulations as applied in specific circumstances can only <br />be decided on a case-by-case basis through litigation. <br />(The above is not intended to be a comprehensive list of all questions <br />which a local government administrator may encounter when adopt- <br />ing floodplain regulations.) <br /> <br />COLOIlADO FLOOD RELATED LEGISLATION <br /> <br /> llgi,lltion'.
