.

.

.

April 28, 2000
Mr. Schulz
Page 2

We anticipate Otero County will work with the adjacent property owners to negotiate any necessary
easements for the drainage solutions. Other potential survey, environmental or utility issues will have
to be resolved during the development of the project.

Upon award of the FEMA Grant, CDOT will have to enter an intergovernmental agreement (IGA)
with Otero County. We recently worked with Prowers County on a very similar agreement and, if
Otero County so desires, CDOT can provide an initial draft agreement for review and approval.

I believe this is an excellent opportunity to work together to solve our mutual problems. Please
contact me if you need any additional supporting information for your grant application. As soon as
you let us know about award of the grant we can proceed with meetings to finalize our agreements.

I look forward to working with you and taking these positive steps toward improving the drainage
problems along SH 50 in Otero County.

Sincerely,

;?b j d~

Robert D.
