1.3 CWCB Construction Fund

The CWCB Construction Fund consists of monies appropriated by the General Assembly
and made available for loans to [mance water project planning and construction. The following
procedures and criteria are used by the CWCB to administer the fund:

1.3.1 Eligible Projects

a. Under authority of Section 37-60-119 and 121, CRS, the monies in the
construction fund are to be used for new storage projects which increase the
beneficial consumptive use of Colorado's compact-entitled waters and for the
repair and rehabilitation of existing storage and raw water delivery systems. The
CWCB will fund the following types of water projects through this program:

(1) Construction of new raw water storage reservoirs or enlargement of
existing raw water reservoirs to enhance dry year water supplies of the
State and promote utilization of Colorado's compact entitlements;

(2) Rehabilitation of existing dams to meet safety standards and to recover
restricted storage capacity; and

(3) Rehabilitation of agricultural water supply systems or municipal raw water
supply systems to increase water use efficiency, maintain or increase
supplies, and to increase beneficial consumptive use.

b. The costs of acquisition of land and water rights are not eligible for CWCB
funding except as part of a project.

c. The CWCB does not provide funding for municipal water treatment and
distribution systems.

d. Limited funding is available for flood control projects.

e. Projects may be designed for multiple use and provide for cost sharing by other
potential uses not funded by the Board such as fish and wildlife, and recreation.

3
