<br />01 39-26-123.2, C.R.S., shall be transferred to the wildlife cash <br />02 fund created in section 33-1-112 (1), C.R~S., for use by the <br />03 division of wildlife, department of natural resources, for the <br />04 sole purpose of mitigating losses of wildl ife and aquatic <br />05 habitat and of mitigating other adverse environmental impacts <br />06 occasioned by the future construction, operation, and use, or <br />07 by the future repair, rehabilitation, and 'enlargement, of <br />08 nonfederal water projects. <br />09 (b) It is the purpose and intent of paragraph (a) of this <br />10 subsection (2) that the mitigation of such losses and impacts <br />11 shall be the singular responsibility of the state of Colorado <br />12 and shall be carried out solely with the moneys provided to <br />13 the division of wildlife pursuant to paragraph (a) of this <br />14 subsection (2). The costs of such mitigation shall be <br />15 nonreimbursable. <br />16 (c) No mitigation of environmental impacts other than <br />17 those whose costs are within the amounts available pursuant to <br />18 paragraph (a) shall be demanded or recommended, either <br />19 directly or indirectly, by any agency of Colorado state <br />20 government. <br />21 (3) Eighty percent of the moneys credited to the fund <br />22 shall be available for appropriation by the general assembly <br />23 for funding, in whole or in part, and in cooperation with <br />24 federal, state, or local agencies and entities: <br />25 (a) Planning studies, including environmental <br />26 assessments and environmental impact statements, for Colorado <br />27 water projects, the costs of which assessments and statements <br />28 shall be nonreimbursable; <br /> <br />-3- <br />
