<br />.' <br /> <br />01 <br /> <br />37-96-102. Purposes of the fund. <br /> <br />(1) In order that the <br /> <br />02 people of the state of Colorado may, as a matter of statewide <br /> <br />03 concern, have and enjoy the perpetual use of those waters <br /> <br />04 apportioned to the state of Colorado by interstate compact, <br /> <br />05 and in order to dispose of any current or future claims for <br /> <br />06 compensation, compensatory storage, damages, or mitigation of <br /> <br />07 damages originating within the basin' of origin because of <br /> <br />08 present or future transbasin diversions, notwithstanding any <br /> <br />09 provision of section 37-45-118 (l)(b)(IV), of part 5 of <br /> <br />10 <br /> <br />article 65.1 of title 24, C.R.S., or of any other law to the <br /> <br />11 <br /> <br />contrary, fifteen percent of the annual revenues credited to <br /> <br />12 <br /> <br />the fund pursuant to section 39-26-123.2, C.R.S., together <br /> <br />13 with the interest accruing from the investment thereof, shall <br /> <br />14 <br /> <br />be used to plan and construct reservoirs and related <br /> <br />15 <br /> <br />facilities in western CoIorado with a collective available <br /> <br />16 capaci ty of not less than three hundred thousand acre-feet, <br />17 excluding the available capacity of the Animas-La Plata <br /> <br />18 participating project of the Colorado river storage project, <br />19 of which amount not less than two hundred twenty-five thousand <br /> <br />20 <br />21 <br /> <br />acre-feet shall be available exclusively for future uses in <br /> <br />western Colorado and not less that seventy-five thousand <br /> <br />22 <br /> <br />acre-feet shall be available to make exchanges or compact <br /> <br />23 deliveries required to accomodate diversions from the Colorado <br /> <br />24 <br /> <br />river basin for uses outside the basin within the state of <br /> <br />Colorado. <br /> <br />25 <br /> <br />(2) (a) At the end of each fi scal year, five percent of <br /> <br />26 <br /> <br />the annual revenues credited to the fund pursuant to section <br /> <br />-2- <br />
