<br />WHEREAS, said new report provides, on the basis of a hydrologic analysis, <br />topographic mapping, the construction of a flood control project, and a revised hydraulic _ <br />analysis, detailed information that is more accurate and current than the approximate ,., <br />information contained in that portion of the August 1, 1983 report previously designated by <br />Resolution No. 221, relating to the reach of Beckers Lane Tributary extending from its <br />confluence with Fountain Creek upstream a distance of 1300 feet; and <br /> <br />WHEREAS, the City of Manitou Springs, Colorado has requested the Colorado <br />Water Conservation Board to designate and approve the floodplains set forth in the <br />aforesaid new report; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the <br />Colorado Water Conservation Board to assist in the prevention of floods and flood damages <br />therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only after designation and <br />approval by the Colorado Water ConServation Board; and <br /> <br />WHEREAS, Section37-6D-106(1)( c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation to designate and approve storms or floodwaters runoff channels or <br />basins and to make such designations available to legislative bodies of local jurisdictions; _ <br />and ,., <br /> <br />WHEREAS, the information in said new report heretofore described in this <br />resolution meets all of the requirements for detailed floodplain information listed under the <br />Board's "Rules and Regulations for the Designation and Approval of Floodplains and of <br />Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />NOW, lHEREFORE, BE IT RESOLVED by the Colorado Water Conservation <br />Board in regular meeting assembled in Denver, Colorado, this 5th day of March, 1993, that <br />it does hereby designate and approve as detailed floodplain information the 100-year <br />floodplains as described by the floodwater surface elevations and profiles in said new report, <br />dated August 19, 1991, heretofore described in this resolution, and does hereby rescind that <br />portion of Resolution No. 221, dated January 5, 1984, regarding the approximate <br />information for that portion of Beckers Lane Tributary extending from its confluence with <br />Fountain Creek upstream for a distance of 1300 feet, as presented in the August 1, 1983 <br />report; and <br /> <br />BE IT FURlHER RESOLVED that the Secretary of the Board is directed to send <br />a certified copy of this resolution to the Board of County Commissioners of EI Paso County, <br />Colorado; the City of Manitou Springs, Colorado; the City of Colorado Springs, Colorado; <br />the Colorado Office of Emergency Management; and the Federal Emergency Management <br />Agency. <br /> <br />e <br /> <br />2 <br />
