Dear Mr. Headley:

This is J1ff response to your letter of March 14, 1983 requesting FEMA's review
of El Paso County's Land Development Code to detenn1ne their adequacy to satisfy
regul atory requi rements., "

In order for local floodplain management ordinances to be acceptable and compliant
they lIIJst conform precisely to the National Flood Insurance Program Regulations.
The County's Land Development Code does not lIII!et the test of conformity due to
a nLllber of significant omissions ..aswell as wording variations from the FEMA
regulations.

I have enclosed two Guide for Ordinance Development booklets to assist you in
drafting a compliant ordinance. No. 1 (c) is to be used if your overlays will
have a floodplain only. No. 1 (d) is for floodplain plus floodway.

Finally, construction standards must be included, even though the zone precludes
new structural development, since a variance could be issued to permit new con-
struction. Also a replacement mobile home on an existing lot needs to meet the
anchori ng standa rds.
