<br />FPR 234 <br /> <br />) <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />July 13, 1984 <br /> <br />RES 0 L UTI 0 N <br /> <br />WHEREAS, a floodplain information report entitled <br />"Approximate Floodplain Areas in Eagle County," dated June 15, <br />1984, has been prepared by Eagle County and the U.S. Geological <br />Survey at the request of Eagle County; and <br /> <br />WHEREAS, said report describes and outlines the f160dplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; and . <br /> <br />WHEREAS, the Board' of County Commissioners of Eagle County <br />has requested the Colorado Water Conservation Board to designate <br />and approve the floodplain areas as set forth in the aforesaid <br />\ report: and <br />-:;;:;j <br /> <br />WHEREAS, <br />requires the <br />prevention of <br /> <br />Section 37-60-106(1), Colorado Revised Statutes, <br />Colorado Water Conservation Board to assist in the <br />floods and flood damages therefrom: and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes, provide that such legislative bodies. of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Eagle County officials have stated that they wil.le <br />regulate the approximate storm and floodwater runoff channels on <br />a case-by-case basis according to Section 6-402, Use Regulations <br />for Floodprone Districts, Eagle County; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, <br />directs the Colorado Water Conservation Board to designate and <br />approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local <br />jurisdictions; and <br /> <br />12B <br />res/234 <br />
