<br />WHEREAS, said new report incorporates the floodplain delineation of the Flood Insurance Rate Map <br />dated May 24, 1974; and <br /> <br />WHEREAS, the approximate floodplain delineation contained in said new report is consistent with e <br />the 100-year floodplain delineation in the Master Drainage Study report dated December, 1988; and <br /> <br />WHEREAS, the Town of San Luis, Colorado, has requested the Colorado Water Conservation Board <br />to designate and approve the floodplains set forth in the aforesaid report dated July 1994; and <br /> <br />WHEREAS, Section 37-60-106(1)( c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28- I II, Colorado Revised Statutes, provide that legislative <br />bodies of local jurisdictions may provide zoning regulations for land uses on or along any storm or <br />floodwater runoff channel or basin only after designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said revised report meets all of the requirements for approximate <br />information listed under the Board's "Rules and Regulations for the Designation and Approval of Floodplains <br />and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); e <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in regular <br />meeting assembled in Gunnison, Colorado, this 19th day of July, 1994, that it does hereby designate and <br />approve as approximate floodplain information the 100-year floodplains as described in said new report, <br />dated July 1994 for the stream reaches of the Rito Seco within the corporate limits of the Town of San Luis, <br />as they were in July 1994; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send a certified copy <br />of this resolution to the Town of San Luis; the Board of County Commissioners of Costillo County; the <br />Colorado Office of Emergency Management; and the Federal Emergency Management Agency. <br /> <br />CERTIFICATE <br /> <br />I certify that the foregoing is a true and correct copy of a resolution adopted by a majority vote of <br />the members of the Colorado Water Conservation Board in regular session assembled at Gunnison, Colorado, <br />on the 19th day of July, 1994, at which a quorum was present. <br /> <br />@~c:4 <br /> <br />Daries C.
