<br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1) (cl, Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions: and" ' <br /> <br />WHEREAS, the staff of the Board has reviewed said revised <br />information and data and does hereby recommend to the Colorado <br />Water Conservation Board that the Board designate and approve as <br />floodplain areas those areas inundated by a 100-year flood <br />(intermediate ,regional flood) as described by the floodwater sur- <br />face elevations and profiles in said new report, and further <br />reconunends that the floodplain designation for that portion' of <br />the Montrose Arroyo beginning at a point 300 feet downstream of <br />the centerline crossing of North Seventh Street, thence extending <br />upstream to the centerline crossing of South Twelfth Street <br />(only) and the Uncompahgre River within the present corporate <br />limits of the City of Montrose as approved by Resolution Nos. 165 <br />and 166, adopted December 2, 1980, be rescinded; <br /> <br />NOW, THEREFORE; BE IT RESOLVED by the Colorado Water Conser- <br />vation Board in regular meeting assembled in Denver, Colorado, <br />this 5th day of January 1984,' that it does' hereby designate and <br />approve as floodplain areas those areas described as being inun- <br />dated by a 100-year flood as described by the floodwater ,surface <br />elevations and profiles in said new report, dated September 1, <br />1983, and does hereby rescind those said portions of Resolution <br />Nos. 165 and 166, dated December 2, 1980; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is <br />directed to send a certified copy of this resolution to the City <br />of Montrose; the Board of County Conunissioners of Montrose <br />County; the United States Army Corps of Engineers, Sacramento <br />District; and the Feder,al Emergency Management Agency <br /> <br />C E R T I F I CAT E <br /> <br />I certify that the foregoing is a true and correct copy of a <br />resolution adopted by a majority vote of the members of the <br />Colorado Water Conservation Board in regular session assembled at <br />Denver, Colorado, on the 5th day of January, 1984, at which a <br />quorum was present. <br /> <br /> <br />Secretary <br />
