WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised
Statutes 1973, provide that such legislative bodies of local
jurisdictions may provide zoning regulations for land uses on or
along any storm or floodwater runoff channel or basin only after
designation and approval by the Colorado Water Conservation
Board; and

WHEREAS, Section 37-60-106(1) (cl, Colorado Revised Statutes
1973, directs the Colorado Water Conservation Board to designate
and approve storm or floodwater runoff channels or basins and to
make such designations available to legislative bodies of local
jurisdictions: and" '

WHEREAS, the staff of the Board has reviewed said revised
information and data and does hereby recommend to the Colorado
Water Conservation Board that the Board designate and approve as
floodplain areas those areas inundated by a 100-year flood
(intermediate ,regional flood) as described by the floodwater sur-
face elevations and profiles in said new report, and further
reconunends that the floodplain designation for that portion' of
the Montrose Arroyo beginning at a point 300 feet downstream of
the centerline crossing of North Seventh Street, thence extending
upstream to the centerline crossing of South Twelfth Street
(only) and the Uncompahgre River within the present corporate
limits of the City of Montrose as approved by Resolution Nos. 165
and 166, adopted December 2, 1980, be rescinded;

NOW, THEREFORE; BE IT RESOLVED by the Colorado Water Conser-
vation Board in regular meeting assembled in Denver, Colorado,
this 5th day of January 1984,' that it does' hereby designate and
approve as floodplain areas those areas described as being inun-
dated by a 100-year flood as described by the floodwater ,surface
elevations and profiles in said new report, dated September 1,
1983, and does hereby rescind those said portions of Resolution
Nos. 165 and 166, dated December 2, 1980; and

BE IT FURTHER RESOLVED that the Secretary of the Board is
directed to send a certified copy of this resolution to the City
of Montrose; the Board of County Conunissioners of Montrose
County; the United States Army Corps of Engineers, Sacramento
District; and the Feder,al Emergency Management Agency

resolution adopted by a majority vote of the members of the
Colorado Water Conservation Board in regular session assembled at
Denver, Colorado, on the 5th day of January, 1984, at which a
quorum was present.
