RESOLUTION

WHEREAS, the U.S. Army Corps of Engineers, Omaha District, completed a floodplain
information report entitled "Special Flood Hazard Information Report, South Platte River, Volume III,
Logan County - Sedgwick County, Colorado" dated June, 1977; and

WHEREAS, said report included approximate floodplain information for the South Platte River
in the vicinity of the Town of Sedgwick; and

WHEREAS, the Colorado Water Conservation Board, has not approved and designated the
floodplains described in said report; and

WHEREAS, a new report entitled "Flood Insurance Study, Town of Sedgwick, Colorado,
Sedgwick County" dated August 3, 1989, was prepared by the Federal Emergency Management Agency;
and

WHEREAS, said report includes detailed floodplain information for the South Platte River within
the corporate limits of the Town of Sedgwick, as they were on August 3, 1989; and

WHEREAS, the detailed information contained in said new report clarifies, on the basis of
detailed topographic information, the approximate information contained in said previous report dated
June 1977, for that portion of the South Platte River within the corporate limit, of the Town of
Sedgwick, as they were on August 3, 1989, only; and

WHEREAS, the Town of Sedgwick, Colorado, has requested the Colorado Water Conservation
Board to designate and approve the floodplains set forth in the aforesaid new report; and

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water
Conservation Board to assist in the prevention of floods and flood damages therefrom; and

WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that
legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any
storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water
Conservation Board; and

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water
Conservation Board to designate and approve storm or floodwater runoff channels or basins and to make
such designations available to legislative bodies of local jurisdictions; and
