<br />any storm or floodwater runoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br />WHEREAS, the IOO-year flow for certain stream reaches within Gilpin County may be <br />estimated by utilizing the appropriate regression equations as set forth in said Floodplain <br />Information Report dated February 1999, providing that the stream's drainage area falls within the <br />range for the applicable regression equation; and <br /> <br />WHEREAS, the approximate floodplain delineations contained on said maps for the <br />unincorporated portions of Gilpin County that meet the requirements of the regression equations <br />also meet the requirements for approximate information listed under the Board's "Rules and <br />Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff <br />Channels in Colorado" (2 CCR 408-1); and' <br /> <br />WHEREAS, a procedure for determining approximate hydrology information in Gilpin <br />, County for approximate floodplains oflakes, ponds, local storm drainage areas, and overflows from <br />irrigation ditches and canals has not been established by the CWCB; and those floodplain areas <br />may only be designated with the understanding that the local government should require that a <br />detailed hydrologic and hydraulic study be performed by a professional engineer and submitted by <br />the developer or the development proponent prior to any floodplain development in those cases; <br />and <br />WHEREAS, hydraulic determinations for the approximate floodplains listed in Table I <br />were prepared by the FIA using approximate hyc;lraulic techniques approved under the Board's <br />"Rules and Regulations for the Designation and Approval of Floodplains and of Storm or <br />Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the regulation of floodplains by Gilpin County should take place on a case-by- <br />case basis following the procedures developed by Colorado Water Conservation Board staff as <br />outlined in Table 2: <br /> <br />3 <br />
