<br />WHEREAS, new hydrologic, topographic. and hydraulic <br />information and data were developed by the Urban Drainage and <br />Flood Control District for t:he South Platte River in "Flood <br />Hazard Area Delineation; South Platte River, Denver <br />metropoli tan Area. Sand CreeJ<: to Oxford Avenue" in September. <br />1985; and <br /> <br />WHEREAS. the Colorado Water Conservation Board. as <br />requested by the Urban Drainage and Flood Control District. <br />approved and designated the floodplain of the South Platte <br />River within the City and County of Denver and adjacent <br />communities as described in: said report by Resolution No. 251 <br />on March 14, 1986; and <br /> <br />WHEREAS. new hydrologic. topographic, and hydraulic <br />information and data were developed by the Urban Drainage and <br />Flood Control District for We.terly Creek in "Flood Hazard Area <br />Delineation. Westerly Creek" in March. 1983. and approved and <br />designated by the Colorado Water Conservation Board by <br />Resolution No. 228 on January 5. 1984; and <br /> <br />I <br /> <br />WHEREAS. said new informat:ion replaced information for that <br />portion of Westerly Creek from Kelly Road Darn to the southern <br />entrance to the culvert under the East-West Runways at the <br />southern end of Stapleton Airport contained in "Flood Hazard <br />Area Delineation. Westerly Creek," prepared by the Urban <br />Drainage and Flood Control District in January. 1977. and <br />approved and designated by the Colorado Water Conservation <br />Board by Resolution No. 70 on July 27. 1977; and <br /> <br />WHEREAS. <br />the reach of <br />entrance to <br />southern end <br /> <br />that portion of Resolution No. 70 pertaining to <br />Westerly Creek from Kelly.Road Darn to the southern <br />the culvert under the East-West Runways at the <br />of Stapleton Airport needs to be rescinded; and <br /> <br />WHEREAS. the City and Collnty of Denver has requested the <br />Colorado Water Conservation Board. to designate and approve <br />certain floodplain areas set: forth in the aforesaid Flood <br />Insurance Study. as set forth in Table 4. attached hereto and <br />by this reference incorporated herein; and <br /> <br />WHEREAS. Section 37-60-106(1), Colorado Revised Statutes. <br />requires the Colorado Water Conservation Board to assist in the <br />prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS. Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes. provide that sucn legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />-3- <br />
