Grantor and Grantee have mutually determined the value <br /> <br />of the Temporary Diversion Easement and Temporary Fill Easements <br /> <br />to be $ <br /> <br />( <br /> <br />dollars and <br /> <br />cents) which shall be in hand paid by Grantee to Grantor within <br /> <br />days of the final execution of this agreement. <br /> <br />3. The following covenants and agreements relate to the <br /> <br />Temporary Diversion Easement as Described in Exhibit A and in <br /> <br />no way whatsoever relate to those Temporary Fill Easements <br /> <br />described in Exhibits Band C. <br /> <br />A. The State, the Corps and their contractors, agents and <br /> <br />employees may enter the property described in Exhibit A for the <br /> <br />purpose of maintaining and constructing a temporary diversion <br /> <br />channel which is necessary for the Project. Said diversion <br /> <br />channel shall not be on the property described in Exhibit A, but <br /> <br />shall be located directly adjacent to the east side of said <br /> <br />property. The Temporary Diversion Easement shall be utilized <br /> <br />for mobilization and staging area for construction equipment and <br /> <br />materials and for use as a temporary stockpile area for excavated <br /> <br />material. <br /> <br />. <br /> <br />B. The State, the Corps and their contractors, agents and <br /> <br />employees shall protect the Temporary Diversion Easement property <br /> <br />from damage, including erosion, due to the maintenance and con- <br /> <br />struction of the diversion channel. <br /> <br />-3- <br />
