<br /> <br />~ <br /> <br />DRAFT <br /> <br />~ <br /> <br />TEMPORARY EASEMENT AGREEMENT <br /> <br />THIS AGREEMENT. made this day of <br />1984 by and between Peter Kiewit Sons' Co.. sometimes known as <br />Peter Kiewit Sons Company. a Nebraska corporation. whose address <br />is 1000 Kiewit Plaza. Omaha. NE 68131. hereinafter referred to <br />as the Grantor and the State of Colorado for the use and benefit <br />of the Department of Natural Resourceb acting by and through the <br />Colorado Water Conservation Board. hereinafter referred to as the <br />Grantee or the State. <br /> <br />. <br /> <br />WHEREAS. authority exists Ln the law and funds have been <br />budgeted. appropriated and othe~wise made available and a sufficient <br />unencumbered balance thereof remains available for payment in <br />Fund Number . G/L Account Number . <br />Contract Encumbrance Number ; and <br /> <br />WHEREAS. required approval. clearance and coordination has <br />been accomplished from and with appropriate agencies; and <br /> <br />WHEREAS. the Grantor is the owner and in possession of certain <br />lands located in the County of Arapahoe.,in the State of Colorado <br />which are more particularly described in Exhibit A. hereinafter <br />referred to as the Temporary Diversion Easement. and Exhibit B <br />and Exhibit C hereinafter referred to as the Temporary Fill Easements. <br /> <br />~ <br />
