<br />- <br /> <br />, <br /> <br />ARTICLE II <br /> <br />In consideration of the covenants of the Railway Co~pany <br />hereinafter contained and of the faithful performance of the <br />same, the District agrees: <br />1. To notify the Assistant General Manager, Engineering <br />of the Railway Company thirty (30) days in advance of any trial <br />erection of the stop-logs or work, either construction or <br />naintenance, to be performeu on aforesaid stop-log structure. <br />2. To secure approval of the Assistant General Manager, <br />E;ngineering of the r.ailw-ay Cor..pany in writing on all 1'1ans or <br />work programs that in any manner affect railroad property in <br />the vicinity of the stoF'-log structure. <br />3. To secure approval of the Assistant General Man~ger, <br />Engineering of the Railway Conpany, or his authorized reprcser:t- <br />ative, prior to placing closure across the railroau. <br />4. To assume all liability of whatsoever cauSe to persons <br />or property due to or resulting frOI:\ use of ~le property of the <br />Railway Company and will indemnify anu held harmless the <br />Railway Company from all such liability due to the use of <br />property of the Railway Company as herein provided. <br /> <br />- 3 - <br />
