<br />, <br /> <br />THIS AGREEMENT, Made and entered into this 24th day <br /> <br />of <br /> <br />, 1979 <br /> <br />, by and between the ATCHISON, <br /> <br />8e:Jte=ber <br /> <br />TOPEKA AND SANTA FE RAILWAY COMP&~, a corporation, (hereinafter <br /> <br />called the "Railway Company") and the HOLLY FLOOD CONTRO:', <br />DRAINAGE AND SJU,ITATION DISTRICT, prowers County, Colorado, <br /> <br />a public corporation of Colorado (hereinafter called the <br /> <br />"District"). <br /> <br />R E C I TAL S: <br />------- <br /> <br />Under ~le authority of Section 205 of the Flood Control <br /> <br />Act Approved June 30, 1948 as amended, the ID1ITED STATES OF <br /> <br />AMERICA, represented by the United States Army Engineer District, <br /> <br />hlbuquerque, will design an~ construct a flooc control project <br /> <br />in ~le vicinity of Holly, Colorado, and the District is the <br /> <br />. <br /> <br />sponsor for the project. <br /> <br />Tile District, as sponsor, has given assurances to the <br /> <br />United States that it will fulfill the re~uirements of Section <br /> <br />204 of the Flood Control Act of 1965, as amendec. <br /> <br />The District will provide, without cost to the United <br /> <br />States, all lands, eas~ents and rights-of-way necessary for the <br /> <br />construction of the project, and upon completion of ~~e project, <br /> <br />the project will become the property of the District with <br /> <br />operation and maintenance responsibilities. <br /> <br />The Railway Company owns land, railroad embankment, tracks <br /> <br />and other railroad appurtenances along the east bank of Wild <br /> <br />Horse Creek that will interfere with the construction, operations <br /> <br />and maintenance of the project. <br /> <br />- 1 - <br />
