<br />, <br /> <br />.' <br /> <br />the property interests held by the Town are sufficient to protect the Government <br /> <br />in entering upon and constructing such Project. <br /> <br /> <br />3. The District hereby gives the Government a right to enter, at <br /> <br />reasonable times and in a reasonable manner, upon lands which the District owns <br /> <br />or controls, for access to the Project for the purpose of inspection, and for the <br /> <br /> <br />purpose of completing, repairing and maintaining the Project if such inspection <br /> <br /> <br />shows that the District. for any reason. is failing to repair and maintain the <br /> <br /> <br />Project in accordance with the assurances hereunder and has perSisted in such <br /> <br /> <br />failure after a reasonable notice in writing by the Government delivered to the <br /> <br /> <br />President or Secretary of the District. No repair and maintenance by the Govern- <br /> <br /> <br />ment in such event shall operate to relieve the District of responsibility to <br /> <br /> <br />meet its obligations as set forth in paragraph 1 of this Agreement~ or to pre- <br /> <br /> <br />clude the Government from pursuing any ather remedy at law or equity. <br /> <br />4. The District promises to comply with the Relocation Assistance Act; <br /> <br />and without limiting the generality of the foregoing, promises: <br /> <br /> <br />a. Payments and services required by Sections 210 and 305 of the Act, <br /> <br />as implemented by regulations prescribed by or under the authority of the <br />Secretary of the Army, will be provided. <br /> <br />b. Within a reasonable time prior to displacement, decent, safe and <br /> <br /> <br />sanitary dwellings will be made available to displaced persons in accordance <br /> <br />with standards established by regulations prescribed by or under the authority <br /> <br /> <br />of the Secretary of the Army. <br /> <br /> <br />c. In acquiring real property, the District will be guided to the <br /> <br /> <br />greatest extent practicable by the land acquisition policies in Sections 301 and <br /> <br /> <br />302 of the Act; and property owners will be paid or reimbursed for necessary <br /> <br /> <br />expenses as specified in Sections 303 and 304 of the Act; all as implemented <br /> <br /> <br />by regulations prescribed by or under the authority of the Secretary of the Army. <br /> <br /> <br />d. The District will furnish an annual report on its activities with <br /> <br />respect to the programs and policies established or authorized by the Act to <br /> <br />facilitate compliance with the reporting requirement contained in Section 214 <br /> <br />thereof. <br /> <br />5. This Agreement is subject to the approval of the Secretary of the <br /> <br />Arll!l'. <br /> <br />3 <br />
