<br />The degree of flood protection required by this <br />Section is considered reasonable for regulatory <br />purposes and is based on engineering and scientific <br />methods of study. Larger floods may occur on rare <br />occasions or the flood height may be increased by <br />natural or man-made causes, such as mud slides and <br />and bridge openings restricted by debris. This <br />Section does not imply that areas outside Floodway <br />and Floodway Fringe District boundaries or land uses <br />permitted within such districts will be free from <br />flooding or flood da~ages. This Section shall not <br />create liability on the part of El Paso County or <br />any officer or employee thereof for any flood damages <br />that may result from reliance on this Section or any <br />administrative decision lawfully made thereunder. <br /> <br /> <br />V I I I . <br /> <br />OFF-STREET PARKING REQUIREMENTS <br /> <br />All uses permitted in the Floodway and Floodway <br />Fringe Districts must meet the off-street parking <br />requirements as stated in Section XXXXI-A. of the <br />El Paso County Zoning Resolutions. <br /> <br />IX. WARNING AND DISCLAIMER OF LIABILITY <br /> <br />X. NONCONFORMING USES <br /> <br />A. A Structure or the Use of a Structure or Premises <br />Which Was Lawful Before the Passage of This Section <br />But Which Is Not in Conformity With the Provisions <br />of This Section May Be Continued Subject to the <br />Following Conditions. <br /> <br />1) No such use shall be expanded, changed, enlarged <br />or altered in a way which increases its noncon- <br />formity. <br /> <br />2) A nonconforming use or structure may be repaired <br />whenever necessary or desirable to the use of <br />such use or structure, but if any nonconforming <br />use or structure is destroyed by any means, <br />including floods, to the extent of more than <br />fifty percent (50%) of its value, as determined <br />by the Board of Adjustment, such nonconforming <br />use shall thereafter be discontinued. <br /> <br />3) If a nonconforming use is discontinued for a <br />period of two (2) years or more, any future use <br />of such land or structure shall be in conformity <br />with the provisions herein. A nonconforming use, <br />of land or building, if changed to a conforming <br />use, may not thereafter be changed back to any <br />nonconforming use. <br /> <br />4) Any existing nonconforming use may be changed to <br />another nonconforming use which is of a more <br />restricted classification in the opinion of the <br /> <br />- 27 - <br />
