<br />GC-3 The Contract. The agreement between the Contractor and the Owner shall <br />be deemed to have been made in the State of Colorado and shall be <br />governed, interpreted and construed in accordance with the laws of the <br />State of Colorado. Thus, the Contractor shall at all times comply with <br />the provisions of the Charters, Ordinances, Rules and Regulations of <br />the local jurisdiction authority where the work is to be performed as <br />well as those of the State of Colorado, and those Federal Laws, Rules <br />and Regulations which in any manner limit, control, or apply to the <br />actions or operations of the Contractor, his subcontractors, or his or <br />their employees, agents or servants engaged upon the work or affecting <br />the materials supplied to or by them. <br /> <br />GC -4 DE LETED <br /> <br />GC-5 Engineer. <br /> <br />The ENGINEER shall design a facility and to describe that design by the <br />preparation of drawings and specifications. <br /> <br />The ENGINEER shall participate in the <br />progress and fi nal payment est imates <br />inspections while the WORK is in progress <br />acceptance by the OWNER. <br /> <br />AUTHORITY OF ENGINEER. The ENGINEER shall act as the OWNER'S <br />representative during the construction period. He shall decide <br />questions which may arise as to quality and acceptability of materials <br />fu rn is hed and WORK perfo rmed. He shall interpret the intent of the <br />CONTRACT DOCUMENTS in a fair and unbiased manner. The ENGINEER will <br />make visits to the site and determine if the WORK is proceeding in <br />accordance with the CONTRACT DOCUMENTS. <br /> <br />preparation and approval of <br />and shall participate in <br />and especially prior to final <br /> <br />The CONTRACTOR will be held strictly to the intent of the CONTRACT <br />DOCUMENTS in regard to the quality of materials, workmanship and <br />execution of the WORK. Inspections may be made at the factory or <br />Fabrication plant of the source of material supply. <br /> <br />The ENGINEER will not be responsible for the construction means, <br />controls, techniques, sequences, procedures, or construction safety. <br /> <br />The ENGINEER shall promptly make decisions relative to interpretation <br />of the CONTRACT DOCUMENTS when requests are di rected to the ENGINEER <br />in writing. <br /> <br />APPROVAL BY ENGINEER. Approval by the ENGINEER of any DRAWING, <br />SPECIFICATION, material, equipment, product or process shall only be <br />construed to mean approval in accordance with the overall design <br />concept and the intent of the PLANS and SPECIFICATIONS and shall not <br />relieve the CONTRACTOR of his responsibility to insure that all <br />dimensions, grades, and the quality and compatibility of any material, <br />equipment, process or product furnished are suitable for the purpose <br />intended and are in compl i ance with all requi rements of the CONTRACT <br />DOCUMENTS. <br /> <br />IV-6 <br /> <br />(1667-3/90) <br />
