Only those interpretations, clarifications and explanations issued in
writing by the Engineer, either by Addenda or by a formal written
decision, will be binding. Oral or other interpretations, clarifications
or explanation will be without legal effect.

IB-12 Alternate Equipment. Bids on alternate equipment proposed by the Bidder
must be approved by the Engineer prior to award.

IB-13 Withdrawal of Bid. A bidder may withdraw his Proposal at any time prior
to the expi ration of the period set forth in the "Invitation for Bids"
for the receipt thereof by maki ng written request upon the Mayor for
such withdrawal. Such request must be signed in the same manner as the
Proposal and by the same person or persons. After the expiration of
such period, no Proposal can be withdrawn or modified.

IB-14 Ofening of Proposals. Bidders are invited to be present at the opening
o the Proposals.

IB-15 Award of Contract. The Owner reserves the right to award the Contract
at any time within sixty (60) days from the date of the opening of Bids
unless otherwise specified in the special Contract Conditions. The
Owner further reserves the right to reject any and all bids and waive
any and all informalities, and the right to disregard all nonconforming
or conditional Bids or counter proposals.

In evaluating Bids, the Owner will consider the qualifications of the
Bidders, whether or not the Bids comply with the prescribed
requirements, and alternates and unit prices if requested in the
Proposal forms. It may consider the qualifications and experience of
Subcontractors and other persons and organizations (including those who
are to furnish the principal items of material or equipment) proposed
for those portions or the Work as to which the identity of
Subcontractors and other persons and organizations must be submitted as
speci fied on the Proposal Form. It may conduct such investigations as
it deems necessary to establish the responsibility, qualifications and
financial ability of the Bidders, proposed Subcontracts and other
persons and organizations to do the Work in accordance with the Contract
Documents to the Owner's satisfaction within the prescribed time. The
Owner reserves the right to reject the Bid of any Bidder who does not
pass any such evaluation to the Owner's satisfaction.

If a Contract is to be awarded, it will be awarded to the lowest
responsible Bidder whose evaluation by the Owner indicated to the Town
that the award will be in the best interests of the Project. If the
Contract is to be awarded, the Owner will give the apparent successful
Bidder a Notice of Award within sixty days after the day of the Bid
Opening.

IB-16 Pre-Bid Conference Synopsis. If a Pre-Bid Conference is held, a copy
of the synopsis of the meeting may be sent to all bidders. If a
synopsis is sent to all bidders then all bidders are required to
acknowledge the receipt of the Pre-Bid Conference Synopsis by signi ng
in the place provided and including it with the Proposal when
SUbmitting the bid.
