<br />WHEREAS, a floodplain information report entitled "Flood,
<br />Hazard Information, Uncompahgre River," dated Febr~ary, 1980, has
<br />been prepared by theUnited,States Army Corps ,of Engineers,
<br />Sacramento District, at the, request of the City of Montrose, the
<br />Town of Olathe, and Montrose countyr and
<br />
<br />'WHEREAS, said report describes and outlines the floodplain
<br />data and information for the storm and floodwater r~noff channels
<br />or basins of the study arear and
<br />
<br />)
<br />
<br />, WHEREAS, the city of Montrose and the BOard of County
<br />commissioners ,of Montrose County have'req~ested,the Colorado Water
<br />Conservation Board to designate and, approve the floodplain areas
<br />as set fOrth ,in the aforesaid report; and
<br />
<br />WHEREAS, the Town of Olathe has not requested designation
<br />and approval but has Iloobjections to such designation and approval
<br />being made for those areas outside of its corporate limits ; and
<br />
<br />WHEREAS; Section 37-60-106(1), 'colorado Revised statutes 1973,
<br />requires ,the ColoradO Water Conservation Board .to assist in the
<br />prevention of floods ,and flood damages therefrom; and
<br />
<br />WHEREAS, Sections 31";23-201'and 30-28-111, Colorado Revised
<br />Stat~tes,1973, provide that ,such legislative ,bodies of local
<br />j~risdicti6ns may provide zoning regulations for land uses on or
<br />along any storm or floodwater runoff channel or basin only after
<br />designation and approval by the Colorado Water Conservation Board;
<br />and
<br />
<br />WHEREAS, Section, 37,-60-106 (1) (c), Colorado Revised, Statutes

<br />and approve storm or" floodwater runoff channels or basins and to
<br />make such designations available to legislative bOdies,oflocal
<br />jurisdictions; and
<br />
<br />WHEREAS, the staff of the BOard has reviewed said report arid
<br />does hereby recommend to the colorado Water Conservation Board
<br />that the Board designate and approve as floOdplain areas those
<br />areas inundated by a lOO-yearflood (intermediate regional floOd)
<br />as described by the floodwater surface elevations and prOfiles in
<br />said report except for those areas within the Town of Olathe
