<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />8. <br /> <br />As a matter of law, the claimant is entitled to a decree to the effect that there is permitted <br />to flow out of the Big Thompson River into said Idylwild Pipeline, under and by virtue of <br />appropriation as by original construction so much water as will flow in said Pipeline having <br />the dimensions, grade, and carrying capacity as found in Paragraph 5 hereof, a quantity of <br />water estimated at 74 cubic feet per second of time for the benefit of the party lawfully <br />entitled thereto and for use for the manufacture of electric power with Power Priority No.2, <br />as of the date of the 14th day of July, A.D. 1913. <br /> <br />IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED by the Court of Colorado that <br />for use in the manufacture of electric power and under and by virtue of appropriation as by <br />original construction and for the benefit of said claimant, the City of Loveland, or the party <br />lawfully entitled thereto, there be permitted to flow out of the Big Thompson River into the <br />Idylwild Pipeline so much water as will flow into said Pipeline to the amount of 74 cubic <br />feet per second of time with Priority No.2, subject to the general and paramount provisions <br />of this decree: the appropriation of which water took effect on and said Priority No.2 dates <br />from the 14th day of July, A.D. 1913. <br /> <br />EXHIBIT "E" <br /> <br />This decree is part of the application for license <br />made by the undersigned this date i?9 <br />of Nouq"",b/?r 1977. <br /> <br />City of Loveland, Colorado <br /> <br /> <br />~ ~~~~ <br />
