3, Description of proposed reconstruction project

a. 35'-40' high reinforced concrete gravity diversion dam having a 130'
long overflow section, one 36" inlet gate, and one 4' x 6' sluice gate,
located at the exact predisaster location.

b. Approximately 1700 LF of 36' steel or prestressed concrete pipe installed
at the predisaster location.

c. Power plant site located at the predisaster location.

26'+ x 30'+ reinforced concrete building with natural stone facing,
two-450 KW-(4160) volt) generator/650 HP turbine units including
related equipment, one 3 phase. 4160-22,000 volt. 750 KVA sub-
station, and an open tailrace.

(2) The 5-room house, 4-stall garage, toolshed, potable water system,
septic system and leach lines and two substations will not be
reconstructed,

C. HUD Program and Description - Federal Disaster Assistance, Section 402(e),
Disaster Relief Act of 1974, PL 93-288

The purpose of this Act is "to provide an orderly and continuing means of
assistance by the Federal Government to State and local governments in carry-
ing out their responsibilities to alleviate the suffering and damage" which
result from emergencies and major disasters. Section 402(e) contains authority
to provide categorical grants to State and local governments for reconstructing
public facilities damaged or destroyed by a major disaster "on the basis of
design of such facility as it existed immediately prior to such disaster and
in conformity with current applicable codes, specifications, and standards."

Furthermore, Section 405 of the Act provides that actions under Section 402
which "have the effect of restoring facilities substantially as they existed
prior to the disaster" are exempt from the provisions of the National Environ-
mental Policy Act of 1969. Therefore, this clearance is being prepared at the
option of this agency.
