When the Admlnistra.tor ha.s not <br />defined the specia.l flood hazard a.reas <br />within a. community. hu not provided <br />wa.ter surface elevation data, a.nd hu <br />not provided sufficient da.ta to identify <br />the flood way or coastal high ha.za.rd <br />a.rea., but the community ha.s indlca.ted <br />the presence of such ha.za.rds by sub- <br />mi ttlng a.n application to pa.rtlcipate <br />in the Program, the community shall: <br />(1) Require permits for all proposed <br />construction or otber development In <br />the community. including the place- <br />ment of manufa.ctured homes, so that <br />It may determine whether such con- <br />struction or other development is pro- <br />posed within flood-prone areas; <br />(2) Review proposed development to <br />a.ssure that all necessa.ry permits have <br />been received from tbose governmental <br />agenCies from which approval is re- <br />quired by Federal or State law. includ- <br />Ing section 404 of the Federal Water <br />Pollution Control Act Amendments of <br />1972, 33 U .S.C. 1334; <br />(3) Review all permit applications to <br />determine wbether proposed building <br />sites will be reasonably safe from <br />flooding. If a proposed building site is <br />in a. flood-prone a.rea., all new construc- <br />tion and substantial improvements <br />shall (I) be designed (or modified) and <br />adequately anchored to prevent flota- <br />tion, collapse. or lateral movement of <br />the structure resulting from hydro- <br />dynamic and hydrostatic loads, Includ- <br />ing the effects of buoyancy, (Ii) be con- <br />structed wltb materials resistant to <br />flood damage, (ill) be constructed by <br />methods and practices that minimize <br />flood damages. and (1v) be constructed <br />with electrical, beating, ventllatJon, <br />plumbing, and air conditioning equip- <br />ment and other service facilities tha.t <br />a.re designed and/or located so a.s to <br /> <br />J <br /> <br />.... eFR Ch. In- <br />cludlnr ma.nufactured home pa.rkl or <br />subd1vlslonl. to determine whether <br />such proposals will be reasona.bly we <br />from flooding, If a subdivision proposa.l <br />or other proposed new development II <br />in & flood-prone area.. any luch propos- <br />a.ls sha.ll be reviewed to assure tha.t (i) <br />a.ll such proposa.ls a.re consistent with <br />the need to minimize flood damage <br />within the flood-prone a.rea., (II) a.ll <br />public utilities And fa.cllltles, such as <br />sewer, ga.s, electrical. a.nd wa.ter sys- <br />tems are Joca.ted a.nd constructed to <br />minimize or ellmina.te flood dama.ge. <br />a.nd (Jii) a.dequate dralna.ge Is prOVided <br />to reduce exposure to flood ha.za.rds; <br />(5) Require within flood-prone a.reu <br />new and replacement wa.ter supply sys- <br />tems to be designed to minimize or <br />eliminate infil tra.tion of flood waters <br />Into the systems; and <br />(6) Require within flood-prone a.reu <br />(i) new a.nd replacement sanita.ry sew- <br />age systems to be designed to minimize <br />or eliminate infil tra.tion of flood wa.- <br />ters into the systems and discha.rges <br />from the systems into flood waters a.nd <br />(il) onsite waste disposal systems to be <br />located to avoid impairment to them <br />or contamination from them durinr <br />flooding. <br />(b) When the Adminlstra.tor has des- <br />ignated a.reas of special flood hazards <br />(A zones) by the publication of a. com- <br />munity's FHBM or FIRM, but ha.s nei- <br />ther produced water surfa.ce elevation <br />data nor identified a floodway or coast- <br />al high hazard area, the community <br />shall : <br />(1) Require permits for a.ll proposed <br />construction and other developments <br />including the placement of manufac- <br />tured homes, within Zone A on the <br />community's FHBM or FIRM; <br />(2) Require the application of the <br />standards In para.graphs (a.) (2), (3), (4), <br />(5) and (6) of this section to develop- <br />ment within Zone A on the commu- <br />nity's FHBM or FffiM; <br />(3) Require that all new subdivision <br />proposals and other proposed develop- <br />ments (Including proposals for manu- <br />fa.ctured home pa.rks a.nd subd1v1slons) <br /> <br />236 <br />
