In a.ll cases the minimum requirements governing the a.dequa.cy of the flood pla.ln ma.na.gement regula.tlons for flood-prone a.reu &dopted by s. pa.rtlcu- la.r community depend on the amount of technlca.l da.ta forma.lly provided to the community by the Admlnistra.tor. Minimum standa.rds for communities a.re a.s follows; (a.) When the Admlnistra.tor ha.s not defined the specia.l flood hazard a.reas within a. community. hu not provided wa.ter surface elevation data, a.nd hu not provided sufficient da.ta to identify the flood way or coastal high ha.za.rd a.rea., but the community ha.s indlca.ted the presence of such ha.za.rds by sub- mi ttlng a.n application to pa.rtlcipate in the Program, the community shall: (1) Require permits for all proposed construction or otber development In the community. including the place- ment of manufa.ctured homes, so that It may determine whether such con- struction or other development is pro- posed within flood-prone areas; (2) Review proposed development to a.ssure that all necessa.ry permits have been received from tbose governmental agenCies from which approval is re- quired by Federal or State law. includ- Ing section 404 of the Federal Water Pollution Control Act Amendments of 1972, 33 U .S.C. 1334; (3) Review all permit applications to determine wbether proposed building sites will be reasonably safe from flooding. If a proposed building site is in a. flood-prone a.rea., all new construc- tion and substantial improvements shall (I) be designed (or modified) and adequately anchored to prevent flota- tion, collapse. or lateral movement of the structure resulting from hydro- dynamic and hydrostatic loads, Includ- ing the effects of buoyancy, (Ii) be con- structed wltb materials resistant to flood damage, (ill) be constructed by methods and practices that minimize flood damages. and (1v) be constructed with electrical, beating, ventllatJon, plumbing, and air conditioning equip- ment and other service facilities tha.t a.re designed and/or located so a.s to J .... eFR Ch. In- cludlnr ma.nufactured home pa.rkl or subd1vlslonl. to determine whether such proposals will be reasona.bly we from flooding, If a subdivision proposa.l or other proposed new development II in & flood-prone area.. any luch propos- a.ls sha.ll be reviewed to assure tha.t (i) a.ll such proposa.ls a.re consistent with the need to minimize flood damage within the flood-prone a.rea., (II) a.ll public utilities And fa.cllltles, such as sewer, ga.s, electrical. a.nd wa.ter sys- tems are Joca.ted a.nd constructed to minimize or ellmina.te flood dama.ge. a.nd (Jii) a.dequate dralna.ge Is prOVided to reduce exposure to flood ha.za.rds; (5) Require within flood-prone a.reu new and replacement wa.ter supply sys- tems to be designed to minimize or eliminate infil tra.tion of flood waters Into the systems; and (6) Require within flood-prone a.reu (i) new a.nd replacement sanita.ry sew- age systems to be designed to minimize or eliminate infil tra.tion of flood wa.- ters into the systems and discha.rges from the systems into flood waters a.nd (il) onsite waste disposal systems to be located to avoid impairment to them or contamination from them durinr flooding. (b) When the Adminlstra.tor has des- ignated a.reas of special flood hazards (A zones) by the publication of a. com- munity's FHBM or FIRM, but ha.s nei- ther produced water surfa.ce elevation data nor identified a floodway or coast- al high hazard area, the community shall : (1) Require permits for a.ll proposed construction and other developments including the placement of manufac- tured homes, within Zone A on the community's FHBM or FIRM; (2) Require the application of the standards In para.graphs (a.) (2), (3), (4), (5) and (6) of this section to develop- ment within Zone A on the commu- nity's FHBM or FffiM; (3) Require that all new subdivision proposals and other proposed develop- ments (Including proposals for manu- fa.ctured home pa.rks a.nd subd1v1slons) 236
