Contractor shall comply with all applicable laws, ordinances, rules <br />and regulations and orders of any public body having jurisdiction for <br />the safety of persons or property or to protect them from damage, <br />injury or loss; and shall erect and maintain all necessary safeguards <br />for such safety and protection. Contractor shall notify owners of <br />adjacent property and utilities when prosecution of the Work may affecl; <br />them. All damage, injury, loss to any property referred to in para- <br />graphs 6.11.A.2 or 6.11.A.3 caused, directly or indirectly, in whole 01" <br />in part, by Contractor, any Subcontractor or anyone directly or indire,:tly <br />employed by any of them of anyone for whose acts any of them may be liable, <br />shall be remedied by Contractor (except damge or loss attributable to <br />the fault of Drawings or Specifications or to the acts or omissions of <br />Owner or Architect or anyone employed by either of them or anyone for <br />whose acts either of them may be liable, and the fault or negligence <br />of Contractor). Contractor's duties and responsibilities for the <br />safety and protection of the Work shall continue such time as all the <br />Work is completed and Architect has issued a notice to Owner and <br />Contractor in accordance with paragraph 14.09.A that the Work is <br />acceptable. <br /> <br />C. Contractor shall designate a responsible member of his organization <br />at the site whose duty shall be the prevention of accidents. This <br />person shall be Contractor's superintendent unless otherwise designated <br />in writing by Contractor to Owner. <br /> <br />6.12 EMERGENCIES <br /> <br />A. In emergencies affecting the safety or protection of persons or the <br />Work or property at the site or adjacent thereto, Contractor, without <br />special instruction or authorization from Architect or Owner, is obli- <br />gated to act to prevent threatened damage, injury or loss. Contractor <br />shall give Architect prompt written notice of any significant changes <br />in the Work or deviations from the Contract Documents caused thereby. <br /> <br />6.13 SHOP DRAWINGS AND SAMPLES <br /> <br />A. After checking and verifying all field measurements, Contractor shall <br />submit to Architect for review and acceptance, in accordance with the <br />General Requirements and the accepted schedule of Shop Drawing sub- <br />missions (see paragraph 2.06.A), all Shop Drawings and samples, which <br />shall have been checked by and stamped with the acceptance of COntrac- <br />tor and identified as Architect may require. <br /> <br />B. Architect will review and accept with reasonable promptness Shop Draw- <br />ings and samples, but Architect's review and acceptance shall be only <br />for conformance with the design concept of the Project and for compli- <br />ance with the information given in the Contract Documents and shall <br />not extend to means, methods, sequences, techniques, or procedures of <br />construction or to safety precautions or programs incident thereto. <br />The review and acceptance of a separate item as such will not indicate <br />acceptance of the assembly in which the item functions. Contractor <br />shall be responsible for coordination of assemblies which include <br />separate components. <br /> <br />C. Where a Shop Drawing or sample is required by the Specifications, no <br />related Work shall be commenced until the submittal has been reviewed <br />and accepted by Architect. <br /> <br />-13- <br />
