tractor to proceed with the Work. Contractor shall be responsible for laying out the Work, shall protect and preserve the established refer- ence points and shall make no changes or relocations without the prior written approval of Owner. Contractor shall report to Architect when- ever any reference point is lost or destroyed or required relocation because of necessary changes in grades or locations, and shall be responsible for replacement or relocation of such reference points by professionally qualified personnel. PART 5 - INSURANCE 5.01 PERFORMANCE AND OTHER BONDS A. Contractor shall furnish a Performance, Payment and Warranty Bond, in an amount at least equal to the Agreement Price as security for the faithful performance and payment of all Contractor's obligations under the Contract Documents. This bond shall remain in effect at least until one (1) year after the date when final payment becomes due, except as otherwise provided by law or regulation or by the Contract Documents. Contractor shall also furnish such other Bonds as are required by the Supplementary Conditions. All Bonds shall be on the forms prescribed by the Contract Documents and be executed by such Sureties as are named in the current list of "Companies Holding Certi- ficates of Authority as Acceptable Sureties on Federal Bonds and as Acceptable Reinsuring Companies" as published in Circular 570 (amended) by the Audit Staff Bureau of Accounts, U.S. Treasury Department. All Bonds signed by an agent must be accompanied by a certified copy of the authority to act. B. If the Surety on any Bond furnished by Contractor is declared a bankrupt or becomes insolvent, or its right to do business is terminated in any state where any part of the Project is located or it ceases to meet the requirements of paragraph 5.01.A, Contractor shall, within five (5) days thereafter, substitute another Bond and Surety, both of which must be acceptable to Owner. 5.02 CONTRACTOR'S LIABILITY INSURANCE A. Contractor shall purchase and maintain such comprehensive general liability and other insurance as will provide protection from claims set forth below which may arise out of or result from Contractor's performance of the Work and Contractor's other obligations under the Contract Documents, whether such performance is by Contractor, by any Subcontractor, by anyone directly or indirectly employed by any of them, or by anyone for whose acts any of them may be liable. 1. Claims under workers' or workmen's compensation, disability benefits and other similar employee benefit acts; 2. claims for damages because of bodily injury, occupational sick- ness or disease, or death of Contractor's employees; 3. claims for damages because of bodily injury, sickness or disease, or death of any person other than Contractor's employees; 4. claims for damages insured by personal injury liability coverage -6- I I I I I I I I I I I I I I I I I I I
