<br />I <br />I <br />I <br />I <br />1 <br />I <br />I <br />, <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />3.02 <br /> <br />REUSE OF DOCUMENTS <br /> <br />A. <br /> <br />Neither Contractor nor any Subcontractor, manufacturer, fabricator, <br />supplier or distributor shall have or acquire any title to or owner- <br />ship rights in any of the Drawings, Specifications or other documents <br />(or copies of any thereof) prepared by or bearing the seal of Archi- <br />tect; and they shall not reuse any of them on extensions of the Pro- <br />ject or any other project without written consent of Owner and Archi- <br />tect and specific written verification or adoption by Architect. <br /> <br />PART 4 - AVAILABILITY OF LANDS; PHYSICAL CONDITIONS; REFERENCE POINTS <br />4.01 AVAILABILITY OF LANDS <br /> <br />A. Owner shall furnish, as indicated in the Contract Documents, the lands <br />upon which the Work is to be performed, rights-of-way for access <br />thereto, and such other lands which are designated for the use of the <br />Contractor. Easements for permanent structures or permanent changes <br />in existing facilities will be obtained and paid for by Owner, unless <br />otherwise provided in the Contract Documents. If Contractor believes <br />that any delay in Owner's furnishing these lands or easements entitles <br />him to an extension of the Contract Time, Contractor may make a claim <br />therefore as provided in Part 12. Contractor shall provide for all <br />additional lands and access thereto that may be required for temporary <br />construction facilities or storage of materials and equipment. <br /> <br />4.02 PHYSICAL CONDITIONS - INVESTIGATIONS AND REPORTS <br /> <br />A. Reference is made to the Supplementary Conditions for identification <br />of those reports of investigations and test of subsurface and latent <br />physical conditions at the site or otherwise affecting cost, progress <br />or performance of the Work which have been relied upon by Architect <br />in preparation of the Drawings and Specifications. Such reports are <br />not guaranteed as to accuracy or completeness and are not part of the <br />Contract Documents. <br /> <br />4.03 UNFORESEEN PHYSICAL CONDITIONS <br /> <br />A. Contractor shall promptly notify Owner and Architect in writing of <br />any latent physical conditions at the site or in an existing structure <br />differing materially from those indicated or referred to in the Con- <br />tract Documents. Architect will promptly review those conditions <br />and advise Owner in writing if further investigation or tests are <br />necessary. Promptly thereafter, Owner shall obtain the necessary <br />additional investigations and tests and furnish copies to Architect <br />and Contractor. If Architect finds that the results of such investi- <br />gations or test indicate that there are latent physical conditions <br />which di ffer materially from those intended in the Contract Documents, <br />and which could not reasonably have been anticipated by Contractor, a <br />Change Order shall be issued incorporating the necessary revisions. <br /> <br />4.04 REFERENCE POINTS <br /> <br />A. Owner shall provide engineering surveys for construction to establish <br />reference point which, in his judgment, are necessary to enable Con- <br /> <br />-5- <br />
