Neither Contractor nor any Subcontractor, manufacturer, fabricator, supplier or distributor shall have or acquire any title to or owner- ship rights in any of the Drawings, Specifications or other documents (or copies of any thereof) prepared by or bearing the seal of Archi- tect; and they shall not reuse any of them on extensions of the Pro- ject or any other project without written consent of Owner and Archi- tect and specific written verification or adoption by Architect. PART 4 - AVAILABILITY OF LANDS; PHYSICAL CONDITIONS; REFERENCE POINTS 4.01 AVAILABILITY OF LANDS A. Owner shall furnish, as indicated in the Contract Documents, the lands upon which the Work is to be performed, rights-of-way for access thereto, and such other lands which are designated for the use of the Contractor. Easements for permanent structures or permanent changes in existing facilities will be obtained and paid for by Owner, unless otherwise provided in the Contract Documents. If Contractor believes that any delay in Owner's furnishing these lands or easements entitles him to an extension of the Contract Time, Contractor may make a claim therefore as provided in Part 12. Contractor shall provide for all additional lands and access thereto that may be required for temporary construction facilities or storage of materials and equipment. 4.02 PHYSICAL CONDITIONS - INVESTIGATIONS AND REPORTS A. Reference is made to the Supplementary Conditions for identification of those reports of investigations and test of subsurface and latent physical conditions at the site or otherwise affecting cost, progress or performance of the Work which have been relied upon by Architect in preparation of the Drawings and Specifications. Such reports are not guaranteed as to accuracy or completeness and are not part of the Contract Documents. 4.03 UNFORESEEN PHYSICAL CONDITIONS A. Contractor shall promptly notify Owner and Architect in writing of any latent physical conditions at the site or in an existing structure differing materially from those indicated or referred to in the Con- tract Documents. Architect will promptly review those conditions and advise Owner in writing if further investigation or tests are necessary. Promptly thereafter, Owner shall obtain the necessary additional investigations and tests and furnish copies to Architect and Contractor. If Architect finds that the results of such investi- gations or test indicate that there are latent physical conditions which di ffer materially from those intended in the Contract Documents, and which could not reasonably have been anticipated by Contractor, a Change Order shall be issued incorporating the necessary revisions. 4.04 REFERENCE POINTS A. Owner shall provide engineering surveys for construction to establish reference point which, in his judgment, are necessary to enable Con- -5-
