Walker <br />Deputy Director <br /> <br />Dear Mr. Flannery, <br /> <br />The Colorado Water Conservation Board staff has reviewed the <br />February, 1983, Draft Summary Report, Upper Platte River Study, <br />prepared by the Bureau of Reclamation, the Fish and Wildlf ife <br />Service and the Geological Survey. <br /> <br />At the outset, I wish to emphasize that Colorado's support <br />for, and participation in, this study was premised upon two <br />conditions: <br /> <br />1. The study would not delay or hamper the construction of <br />the Congressionally authorized NarrCMS Unit, pick-Sloan <br />Missouri Basin Plan, or any other Colorado Project <br />wi thout the express approval of the State of Colorado. <br /> <br />2. In the development of options or alternatives for the <br />use of water in the Upper Platte River Basin, <br />recognition would be given to state water laws, <br />adjudicated water right decrees, interstate compacts, <br />and decrees of the U.S. Supreme Court. <br /> <br />We affirm the conditions stated above. In particular, I <br />wish to emphasize that Congressional authorization of the NarrCMS <br />Unit, the South Platte River Compact, and the U.S. Supreme Court <br />decrees on the North Platte and Laramie Rivers, and adjudicated <br />water right decrees on the South Platte, North Platte and Laramie <br />Rivers in Colorado predate the enactment of legislation providing <br />for the conservation of endangered or threatened species of fish <br />and wildlife.
