Walker
Deputy Director

Dear Mr. Flannery,

The Colorado Water Conservation Board staff has reviewed the
February, 1983, Draft Summary Report, Upper Platte River Study,
prepared by the Bureau of Reclamation, the Fish and Wildlf ife
Service and the Geological Survey.

At the outset, I wish to emphasize that Colorado's support
for, and participation in, this study was premised upon two
conditions:

1. The study would not delay or hamper the construction of
the Congressionally authorized NarrCMS Unit, pick-Sloan
Missouri Basin Plan, or any other Colorado Project
wi thout the express approval of the State of Colorado.

2. In the development of options or alternatives for the
use of water in the Upper Platte River Basin,
recognition would be given to state water laws,
adjudicated water right decrees, interstate compacts,
and decrees of the U.S. Supreme Court.

We affirm the conditions stated above. In particular, I
wish to emphasize that Congressional authorization of the NarrCMS
Unit, the South Platte River Compact, and the U.S. Supreme Court
decrees on the North Platte and Laramie Rivers, and adjudicated
water right decrees on the South Platte, North Platte and Laramie
Rivers in Colorado predate the enactment of legislation providing
for the conservation of endangered or threatened species of fish
and wildlife. Colorado's obligations to Wyoming and Nebraska are
governed by the aforementioned compact and U.S. Supreme Court

527
1/ jf

John R. Felcher, Chiirman. Herbert H.
