<br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said new report for the stream reaches listed in Tables 1, <br />2 and 3 meets all of the requirements for detailed information listed under the Board's "Rules and <br />Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff <br />Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the information in said new report for the stream reaches listed in Tables 4 <br />and 5 meets all of the requirements for approximate information listed under the Board's "Rules <br />and Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater <br />Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the information in said new report for the stream reaches listed in Tables 6 <br />and 7 does not meet all of the requirements for approximate information listed under the Board's <br />"Rules and Regulations for the Designation and Approval of Floodplains and of Storm or <br />Floodwater Runoff Channels in Colorado" (2 CCR 408-1); <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in <br />regular meeting assembled in Denver, Colorado, this 13th day of March, 1996, that it does hereby <br />designate and approve as detailed floodplain information the 100-year floodplains as described <br />in said new report, dated September 30, 1992, for the study reaches listed in Tables 1,2 and 3 <br />and does hereby rescind those portions of Resolution No. 264 relating to the detailed floodplain <br />. information for the stream reaches listed in Tables 1 and 4 and that it does hereby designate and <br />approve as approximate floodplain information the 100-year floodplains as described by the <br />floodplain delineations in said new report, dated September 30, 1992, the approximate floodplain <br />information for the stream reaches listed in Tables 4 and 5 and does hereby rescind those portions <br />of Resolution No. 96-416 relating to the approximate floodplain information for the stream <br />reaches listed in Tables 2 and 5; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed 10 send a <br />certified copy of this resolution to the City of Colorado Springs; the City of Fountain; the City <br />of Manitou Springs; the Town of Monument; the Board of County Commissioners of El Paso <br />County; the EI Paso Regional Building Department; the Colorado Office of Emergency <br />Management; the U.S. Army Corps of Engineers, Albuquerque District; and the Federal <br /> <br />9 <br />
