<br />930 square miles, lakes, ponding areas, local drainage areas and irrigation overflows has not <br />been established by the Guidelines for Determining lOO-year Flows for Approximate <br />Floodplains; and <br /> <br />WHEREAS, the Colorado Water Conservation Board is taking this action under the <br />provisions set forth in 2 CCR 408-1 Rule 9.D.2, (Board Initiative) and the Town of Coal Creek <br />has been notified and their comments have been considered in this resolution; and <br /> <br />WHEREAS, Section 37-60-l06(I)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after designation and approval by <br />the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said new report, with included mapping, for Coal Creek <br />in the Town of Coal Creek, which has a drainage area greater than or equal to 1 square mile and <br />less than or equal to 930 square miles, meets all of the requirements for approximate <br />information listed under the Board's "Rules and Regnlations for the Designation and Approval <br />of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the information in said neW report, with included mapping, for the three <br />unnamed tributaries to Coal Creek, and the unnamed subtributary to one of those tributaries to <br />Coal Creek, which have drainage areas less than 1 square mile, does not meet all of the <br />requirements for approximate information listed under the Board's "Rules and Regulations for <br />the Designation and Approval of Floodplains aIld of Storm or Floodwater Runoff Channels in <br />Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, Colorado Water Conservation Board has determined that the hydrologic <br />methodology developed in the Guidelines f()r Determining lOO-Year Flood Flows for <br />Approximate Floodplains is appropriate fOf designation and approval of approximate <br />floodplain information and for use in simple floodplain analyses for development such as open <br />space, agriculture, fann bridges, bams and individual residential structures, but that the <br />methodology is not appropriate for development involving residential subdivisions greater than <br />50 lots or occurring on sites greater than 5 acres, commercial construction, industrial <br />construction, . construction of public transportation facilities or construction of flood control <br />activities; <br /> <br />2 <br />
