I
I

Hs. If a "no affect"
determination is made, further consultation may not be necessary. However. a
copy of the "no affect" determination for the proposed project should be sent
to this office for our concurrence.

I
I

Our review has also revealed that a number of candidate species for Federal
listing presently exist within Pipestone County. These include the Dakota
skipper butterfly (Hesoera dacotae), loggerhead shrike (Lanius ludovieianus) ,
plains topminnow (Fundulus sciadicus), and the Topeka shiner (Notroois tristis
- tooeka). Although these .candidate" species are afforded no legal
protection under the Endangered Species Act, they are species of special
concern that should be considered in project planning.

I
I

If you have any questions concerning our letter or we can be of further
assistance, please call Hr. Dick Tolbers of my staff at (612) 725-3548.

I
I

These comments have been prepared under the authority of and in accordance
with provisions of the Endangered Species Act of 1973, as amended. We will
provide you or the Corps with our Fish & Wildlife Coordination Act comments
when more specific information becomes available regarding what structural and
nonstructural measures are being considered by the Corps to reduce the
flooding problems within the City of Pipestone and/or along Pipestone Creek.

I
I
I
I
I

Sincerely,

~~,~~

~ynn M.
