<br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />CONSISTENCY WITH PREVIOUS FLOODPLAIN STUDIES <br /> <br />WHEREAS, the detailed floodplain information for the studied reaches contained in said new <br />report dated June 2004 for Ralston and Leyden Creeks revises and is, therefore, inconsistent with the <br />previously published floodplain information for the same stream reaches as studied approximate and/or <br />detailed methods; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHEREAS, the detailed 100-year floodplain information for the studied reaches of Ralston <br />and Leyden Creeks contained in said new report meets the requirements listed under the Board's "Rules <br />and Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff <br />Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the affected local governments should continue to regulate new development and <br />construction in floodplain areas on a case-by-ca~;e basis based on the information presented in said new <br />report, or based on the best available floodplain information that is accessible to the them; and <br /> <br />DESIGNATION, APPROVAL AND RESCISSION ACTION <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in <br />regular meeting assembled in Alamosa, Colorado, this 14th day of September 2004, that it does hereby <br />designate and approve as detailed floodplain information the 100-year floodplain delineations for <br />Ralston Creek and Leyden Creek, located within Jefferson County, the City of Arvada and within the <br />Urban Drainage and Flood Control District, contained in said new report dated June 2004; and <br /> <br />BE IT FURTHER RESOLVED that the Board does hereby rescind the superseded 100-year <br />floodplain information contained in previously published reports for the studied portions of Ralston <br />Creek and Leyden Creek contained in said new report dated June 2004; and <br /> <br />BE IT FURTHER RESOLVED that th~ Secretary of the Board is directed to send a certified <br />copy of this resolution to the Urban Drainage and Flood Control District, Jefferson County, the City of <br />Arvada, and the Federal Emergency Management Agency Region 8, <br /> <br />2 <br /> <br />", <br />
