<br />damage pursuant to the terms or provisions of this
<br />Contract. The duties, obligations and responsi-
<br />bilities of the parties to this Contract with respect to
<br />third parties shall remain as imposed by law.
<br />.
<br />
<br />107.23 Archaeological and Paleontological
<br />Discoveries. When the Contractor's operations
<br />encounter plant or animal fossils, remains of pre-
<br />historic or historic structures, prehistoric or historic
<br />artifacts (bottle dumps, charcoal from subsurface
<br />hearths, old pottery, potsherds, stone tools, arrow-
<br />heads, etc.), the Contractor's affected operations
<br />shall immediately cease. The Contractor shall notify
<br />the Engineer of the discovery of these materials.
<br />When ordered to proceed, the Contractor shall
<br />conduct operations in the vicinity of the discoveries
<br />as directed. The work will be paid for by the Division
<br />as provided in subsection 104.02 when contract unit
<br />prices exist, or as extra work as provided in sub-
<br />section 104.03 when no unit prices exist. Delays to
<br />the Contractor because of the materials encountered
<br />may be cause for extension of contract time in
<br />accordance with subsection 108.06.
<br />
<br />107.24 Air Quality Control. The Contractor ,
<br />shall comply with the "Colorado Air Quality Control [
<br />Act," Title 25, Article 7, CRS and regulations:
<br />promulgated thereunder.
<br />
<br />107.25 Water Quality Control. The Con-
<br />tractor shall comply with the "Colorado Water
<br />Quality Control Act," Title 25, Article 8, CRS
<br />"Protection oiFishing Streams", Title 33, Article 5,
<br />CRS; "Clean Water Act", 33 USC 1344; regulations
<br />promulgated; certifications issued;. and to the
<br />following requirements.
<br />(a) Temporary Water Quality Control.
<br />1. DESCRIPTION. This work shall con-
<br />sist of temporary measures needed to
<br />control water pollution. These temporary .
<br />measures shall include the installation of !
<br />berms, dikes, dams, sediment basins,
<br />fiber mats, netting, gravel, mulches,
<br />grasses, slope drains, and other erosion
<br />control devices or methods, at the.
<br />locations necessary to control erosion,
<br />and water pollution. .
<br />Temporary pollution controls shall be
<br />coordinated with the permanent erosion
<br />control features specified in the Contract. :
<br />2. MATERIALS. Mulches may be hay,'
<br />straw, fiber mats, netting, wood cellulose, i
<br />com stalks, com cobs, bark, wood chips, i
<br />or other suitable material, and shall be!
<br />reasonably clean and free of noxious'
<br />weeds and deleterious materials. .
<br />Slope drains may be constructed of'
<br />pipe, fibsr mats, rubble, portland cement:
<br />concrete, bituminous concrete, plastic.
<br />sheeting, or other acceptable materials. :
<br />
<br />Grass shall be a quick growing species
<br />(such as rye grass, or cereal grasses)
<br />suitable to the area, which will provide
<br />temporary cover and will not later com-
<br />pete with the grasses sown for permanent
<br />cover.
<br />Fertilizer and soil conditioners shall be
<br />acceptable standard commercial grade.
<br />3. CONSTRUCTION REQUIREMENTS.
<br />The Contractor shall provide immediate
<br />permanent or temporary pollution con-
<br />trol measures to prevent contamination
<br />of adjacent streams, lakes, ponds, or
<br />other watercourses or water impound-
<br />ment areas.
<br />Cut slopes shall be seeded and mulched
<br />as the excavation proceeds. The surface
<br />area of erodible earth material exposed at
<br />one time shall not exceed 750,000 square
<br />feet for clearing and grubbing and
<br />750,000 square feet for earthwork
<br />operations.
<br />Temporary pollution control shall
<br />include construction work outside the
<br />right of way where necessary for borrow
<br />pits, haul roads and equipment storage
<br />sites.
<br />The Contractor shall prepare schedules
<br />for accomplishing temporary and per-
<br />manent erosion control work and submit
<br />them for acceptance at the pre con-
<br />struction conference. The schedules for
<br />the proposed method of erosion control
<br />shall include all construction activities
<br />within the project, haul roads, borrow
<br />pits, storage and plant sites, and the plan
<br />for disposal of waste material. Work shall
<br />not be started until the temporary erosion
<br />control schedules and methods of oper-
<br />ations have been accepted.
<br />The Contractor shall incorporate all
<br />permanent erosion control features into
<br />the project at the earliest practicable time
<br />as outlined in the accepted schedule.
<br />Erosion control features shall be main-
<br />tained by the Contractor until the project
<br />is accepted.
<br />In the event of conflict between these
<br />requirements and water quality control
<br />laws, rules, or regulations of other
<br />Federal, State or local agencies, the more
<br />restrictive laws, rules, or regulations
<br />shall apply.
<br />(b) Water Quality Management Requirements.
<br />The Contractor shall perform the following
<br />requirements:
<br />1. All reasonable steps shall be taken to
<br />insure that the Contractor's provisions
<br />for the control of erosion and sedimenta-
<br />tion and the protection of water quality
