<br />create substantial benefits to the citizens of this state through <br />the alleviation of flooding and flood damages; and <br /> <br />WHEREAS, the Colorado Water Conservation Board is an <br />official agency of the executive branch of the government of the <br />State of Colorado and has the power and authority to agree with the <br />recommendations of the Chief of Engineers preliminary to the con- <br />struction of the project; and <br /> <br />WHEREAS, the State of Colorado desires the earliest <br />possible construct.ion of the Bear Creek Dam and Reservoir and wishes <br />to comply with th2 recommendations of the Chief of Engineers; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the State of Colorado, <br />through the Colorado Water Conservation Board, in regular session <br />assembled at Meek2r, Colorado, this 11th day of September, 1970, <br />that it shall: <br /> <br />a. Hold and save the United States free from damages <br />due to water-rights claims resulting from construction and <br />operation of the project; <br /> <br />b. Pre~ent encroachment on the flow-carrying capacity <br />of the Bear Creek Channel below the reservoir and the South <br />Platte River Channel below the confluence of Bear Creek to <br />the extent necessary to provide for effective reservoir oper- <br />ation in the interest of flood control; <br /> <br />c. Adequately inform affected interests, at least <br />annually, that the project will not provide complete flood <br />protection; and <br /> <br />d. Pro~ide guidance and leadership in preventing unwise <br />and uneconomical future development of the flood plain areas <br />by encouraging prudent use of flood proofing, land regulation <br />planning, or other flood plain management techniques to reduce <br />future flood losses.; and <br /> <br />BE IT FURTHER RESOLVED that two true and correct copies <br />of this resolution be furnished to the office of the District <br />Engineer, united States Army Engineers District, Omaha, Nebraska, <br />as evidence of the intent of the State of Colorado, through the <br />Colorado Water Conservation Board, to cooperate to the fullest <br />extent of its power and authority in the construction and subse- <br />quent operation of the said Bear Creek Dam and Reservoir. <br /> <br />-2- <br />
