<br />COLORADO WATER CONSERVATION BOARD <br />102 Columbine Building <br />1845 Sherman Street <br />Denver, Colorado 80203 <br /> <br />RES 0 L UTI 0 N <br /> <br />rf'-rr.i ' <br /> <br />A RESOLUTION GIVING CERTAIN ASSURANCES OF THE STATE OF COLORADO, <br />THROUGH THE COLORl\DO WN:ilR COnSERVA'rION BOARD, TO THE UNITED STATES <br />OF AMERICA RELATIVE TO THE COnSTRUCTION AND OPERATION OF THE BEAR <br />CREEK DAM AND RESERVOIR, A TRIBU'I',;RY OF THE SOUTH PLATTE RIVER IN <br />COLORADO, FOR FLOOD CONTROL PURPOSES. <br /> <br />WHEREAS, by the Flood Control Act of 1968 the congress <br />of the United Statces has authorized the United States Army Corps of <br />Engineers to constcruct and operate the Bear Creek Dam and Reservoir, <br />South Platte River, Colorado, for flood control purposes; and <br /> <br />WHEREAS, the Chief of Engineers has recommended in Senate <br />Document No. 87, 90th Congress, 2Yld Session, in part, that local <br />interests should furnish assurances satisfactory to the Secretary <br />of the Army that they Hill: <br /> <br />"b. Hold and save the united States free from damages <br />due to water-rights claims resulting from construction and <br />operation of the project; <br /> <br />c. Prevent encroachment on the flow-carrying capacity <br />of the Bear Creek Channel below the reservoir and the South <br />Platte River Channel below the confluence of Bear Creek to <br />the extent necessary to provide for effective reservoir oper- <br />ation in the interest of flood control; <br /> <br />d. Adequately inform affected interests, at least <br />annually, that the project will no't provide complete flood <br />protection; and <br /> <br />e. Provide guidance and leadership in preventing <br />unwise and uneconomical future development of the flood <br />plain areas by encouraging prudent use of flood proofing, <br />land regulation planning, or other flood plain management. <br />techniques to reduce future flood losses."; and <br /> <br />WHEREAS, the State of Colorado recognizes that the con- <br />struction and operation of the Bear Creek Dam and Reservoir will <br />
