<br />(4) In acquiring real property it will be guided, -to <br />the greatest ex'tent prac-ticable under s-ta-te law, by the land acquisi,tion <br />policies in Section 301 and 'the provisions of Section 302 of said Act; and <br /> <br />(5) Property owners will be paid or reimbursed for <br />necessary expenses a:, specified in Sections 303 and 304 of said Act. <br /> <br />b. Hold and save the United S'tates free from damages <br />due 'to water.-rights claims resulting from construction and operation <br />of the Project; <br /> <br />C. Pl:even-t encroachment on the flow-carrying capacity of <br />the Bear Creek Channel below the reservoir and the South Platte River <br />Channel below the confluence of Bear Creek to the extent necessary to <br />provide for eff'"ctiv(~ reservoir operation in the interest of flood <br />control. The area r(~quired for the flow-carrying capacity is more fully <br />described in paragraph 3, belov;. The exten't of channel covered by -this <br />agreemen-t is i~he Beal: Creek Channel from inunediately belm\7the dam to <br />the confluence ':lith i:he Sou'th Plat.te River and that portion of the <br />South Platte River Channel ex-tending to Hampden Avenue. The following <br />will be considered as minimum ac-tion required -to fulfill the obligations <br />of preventing encroachmen-ts. <br /> <br />(1) Preven-t man-made encroac1unents such as dumping <br />or wasting of materials in the channel. <br /> <br />(2) Insure that accumulations of debris around <br />structures in the channel such as bridges and weirs will be removed <br />promptly following a flood. <br /> <br />(3) Con-trol all alterations of the channel such as <br />relocat.ing, constric,:ing, enJ_arging, placing of erosion protec,tion and <br />ra~s;Lng or lowering of the adjacent stream banks. Alterations which <br />provide for equal or greater channel capacity will be permitted but <br />must be preceded by adequa-te plans defining -the proposed alterations. <br />A set of plans mus-t he submi-tted to the Government for review and <br />\oJrit'cen concurrence before i.i1i,tiation of the channel alterations. A <br />current file of plans shmving channel al-;:erations must be maintained. <br /> <br />d. Ad.equately inform affec'ted interests. at least annually, <br />'chat 'the Projec't wiLL not: provide complete flood protection; and <br /> <br />e. Provide guia.ance and leadership in preventing unwise <br />and uneconomical future development of the flood plain areas by <br />encouraging prudent use of floodproofing, land regulation planning, or <br />o-ther flood plain managemen,: techniques -to reduce future flood losses. <br /> <br />2.
