<br />LOCAL REOUEST FOR DESIGNATION <br /> <br />WHEREAS, Clear Creek County, Colorado has requested the Colorado Water <br />Conservation Board, by letter dated October 13, 1998, to designate and approve the floodplain <br />information contained in said Flood Insurance Rate Maps dated March 1980 with included <br />Floodplain Information Report dated November 1998; and <br /> <br />WHEREAS, Clear Creek County is aware that new floodplain information is currently <br />being produced by the V,S. Army Corps of Engineers, Omaha District, under contract with the <br />Federal Emergency Management Agency, for certain stream reaches within Clear Creek County; <br />and <br /> <br />WHEREAS, Clear Creek County has not requested the Colorado Water Conservation <br />Board to rescind any of the approximate floodplain information contained on said maps dated <br />March 1980 until such time that new detailed floodplain information supersedes the existing <br />approximate floodplain information; and <br /> <br />C.R.S AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCR TECHNICAL STANDARDS <br /> <br />WHEREAS, the hydrology information for the approximate floodplains for certain streams <br />on said maps dated March 1980 have been determined, or can be estimated, using the information <br />contained within included Floodplain Information Report dated November 1998; and <br /> <br />WHEREAS, a procedure for determining hydrology information in Clear Creek County for <br />approximate floodplains of streams with drainage areas that fall outside the applicable range of the <br />methodology presented in the included Floodplain Information Report and for lakes, ponds, local <br />storm drainage areas, and overflows from irrigation ditches and canals has not been established, and <br />those floodplain areas may not be designated as approximate floodplain information without a <br />procedure for estimating 100-year hydrology, and therefore the local government should require <br /> <br />3 <br />
