Purpose and scope <br />of this part. <br />This part establishes uniform <br />administrative rules for Federal <br />grants and cooperative agree- <br />ments and subawards to State, <br />local, and Indian tribal <br />governments. <br /> <br />44 CFRPART 14 <br /> <br />Section 14.1. Scope of this part. <br />(a) This part contains standards <br />for non-Federal audits of <br />recipients of financial assistance <br />from the Federal Emergency <br />Management Agency . ... This <br />includes, without limitation, <br />assistance under the Disaster <br />Relief Act of 1974 as amended, <br />and the Federal Civil Defense Act <br />of 1950, as amended. <br />(b) FEMA may not impose on <br />recipients additional requirements <br />concerning non-Federal audits. <br />However, it may provide <br />recipients with suggestions and <br />assistance on this subject. <br /> <br />" <br /> <br />PAGE 2-3 <br /> <br />. Comply with FMA requirements, 44 CFR Parts 13 and 14, <br />the grant agreement, and all applicable Federal, State, and <br />local laws and regulations. 44 CPR Parts 13 and 14 contain <br />financial and audit documentation requirements for Federal <br />grants. <br /> <br />. Account for appropriate uses of grant funds to the State POCo <br /> <br />Federal Role <br /> <br />FEMA's role is to work with States to incorporate FMA into the <br />PP NCA process, distribute FMA funds among the States, and <br />support the States in administering FMA by providing technical <br />and other assistance. <br /> <br />FEMA also exercises review and approval authority as described <br />below: <br /> <br />I. The NFlRA assigns FEMA the responsibility of reviewing <br />and approving the Flood Mitigation Plan required of any <br />State or community receiving an FMA project grant. <br />(Chapter 3 of this guidance contains more information about <br />the Flood Mitigation Plan requirement.) <br /> <br />2. FEMA is required to review and approve the environmental <br />documentation and benefit-cost analysis required for approval <br />of a flood mitigation project. <br /> <br />3. FEMA approves project grant applications prioritized by the <br />State for funding. <br /> <br />As the Federal agency responsible for implementing FMA, <br />FEMA is also responsible for reviewing performance and <br />financial reports submitted by the States as agreed upon in the <br />PPA/CA or FMA CA to ensure compliance with all 44 CFR Part <br />13 requirements. FEMA will also review performance and <br />financial reports submitted by communities in States not <br />participating in FMA. <br /> <br />FEMA will account for all funds awarded to each State and <br />community to ensure compliance with legislative funding limits. <br /> <br />FEMA 299/AUGUST 1997 FLOOD MITIGATION ASSISTANCE (FMA) GUIDANCE <br />
