(Supp. 1995) this <br />day of , 1995, by and between the STATE OF <br />COLORADO for the use and benefit of the COLORADO WATER CONSERVATION <br />BOARD, hereinafter referred to as the Grantor, and the <br />, a political subdivision of the State of <br />Colorado, hereinafter referred to as the Grantee. <br /> <br />TEMPORARY CONSTRUCTION EASEMENT <br /> <br />WITNESSETH: <br /> <br />That for and in consideration of the sum of <br />dollars paid to the Grantor by the <br />Grantee and the keeping and performance of the covenants and <br />agreements hereinafter expressed, the Grantor conveys to the <br />Grantee a temporary construction easement for the purpose of use of <br />the land covered by said easement during the construction of <br /> <br />, <br />hereinafter referred to as the Project, upon, over, across, below <br />and through the following portions of lands owned by the Grantor as <br />part of the South Platte Channelization Project (hereinafter <br />.Channelization Project"), situated in the City of <br />County of , State of Colorado, to wit: <br /> <br />(Insert legal description and reference to map attached and <br />incorporated herein) <br /> <br />TO HAVE AND TO HOLD, for the purpose of utilizing such land <br />during the construction of <br />for the term of days, commencing on the <br />, 199 , and ending on the day of <br /> <br />day <br />, 199 <br /> <br />of <br /> <br />The Grantor grants this Easement upon the express condition <br />that the estate herein granted shall endure only so long as the <br />Grantee utilizes the Easement for the sole purpose of the <br />construction of the Project. In the event that any of the land <br />covered by this Easement is used by the Grantee for any purpose <br />other than the specific uses identified herein, then all of the <br />Grantee's right, title and interest in and to the above described <br />property shall become null and void, and the lands and premises <br />shall absolutely revert to and revest in the Grantor as fully and <br />campletely as if this instrument had nat been executed, withaut the <br />necessity for suit .or re-entry; and na act .or amissian an the part <br />.of any beneficiary .of this clause shall be a waiver .of the <br />aperatian .or enfarcement of such clause. <br /> <br />The Grantar and the Grantee expressly cavenant and agree that <br /> <br />Page 1 .of 6 pages <br />
