Bassi l~~ <br />Assistant Attor~General <br /> <br />FROM: <br /> <br />RE: <br /> <br />Draft Easement Forms for Easements Granted Pursuant to <br />Section 24-82-201 et ~, C.R.S. <br /> <br />Attached for your review are two draft easement forms which, <br />when tailored to a specific grantee's proposed use(s), can be used <br />for granting easements to political subdivisions of the State <br />pursuant to Section 24-82-201 et~, C.R.S. I have also attached <br />the statute as amended in 1995. I have incorporated several <br />provisions from the South Suburban easement into these forms. <br /> <br />Because each request for an easement has its own unique <br />characteristics, we probably will want to insert specific condi- <br />tions that are not included in these drafts. For example, you may <br />want to require as-built drawings of projects when construction is <br />completed for certain structures. Will you require grantees to <br />submit the plans and specifications for the proposed structure or <br />facility before deciding whether to grant the easement?
