CO 80203 <br /> <br />Dear Chris: <br /> <br />I am responding to your letter of January 8 concerning the <br />proposed Request for Proposals which the Board forwarded to the <br />Legislative Council last December per the requirements of S.B. <br />15 (1987 Session). Your inquiry was discussed by the Board at <br />its January 28-29 meeting and I was asked to forward this <br />response to you. <br /> <br />First~ your letter asked if the $250.000 for the proposed <br />study is not needed more elsewhere in light of what you <br />describe as the Governor urging a delay in a $5 million <br />repayment to the CWCB construction fund. Presumably. the <br />repayment to which you refer is the one that was provided for <br />by section 2 of chapter 199, Session Laws of Colorado 1987, as <br />codified at section 24-75-213. CRS. Despite the provisions of <br />the cited statute. the last $5 million of the $20 million which <br />was borrowed from the CWCB construction fund two years ago was <br />in fact repaid in June. 1987, and was included in the Closing <br />of the books for FY 1986-87. Therefore, no further repayment <br />is due the construction fund in FY 1987-88. <br /> <br />To my knowledge. Governor Romer is not proposing any <br />further borrowing from the construction fund. However. the <br />staff of the Joint Budget Committee has inquired of me as to <br />the consequences of borrowing yet again from the construction <br />fund. From this, I assume that the Joint Budget Committee has <br />this possibility under consideration. My January 15 memo to <br />Lee Maurer in this regard is enclosed for your convenient <br />reference. <br /> <br />In light of the inquiry from the Joint Budget committee as <br />to the potential borrowing of monies from the CWCB construction <br />fund, the Board has asked that I advise you that it is of the <br />opinion that expending $250.000 for the proposed study would <br />reduce the funds available for the construction of already <br /> <br />6064E <br />
