<br />, <br /> <br />WHEREAS, the Project has been divided into three distinctive <br />"reaches" (Reach One extending from the upstream limit of the Project <br />located at the federal acquisition line of the Chatfield Lake Project <br />to the site of a new channel control weir to be located approximately <br />due east of the street named Fairway Lane in the Town of Columbine <br />Valley; Reach Two extending from that same weir to the present West <br />Oxford Avenue Bridge Crossing; and Reach Three extending from that <br />bridge crossing to the downstream limit of the Project located at the <br />present West Hampden Avenue Bridge crossing) for the purpose of <br />locating individual measures to be implemented; and <br />WHEREAS, the City hereby represents that it has the authority and <br />capability to furnish the non-Federal cooperation required by the <br />Federal legislation authorizing the flood control works and by other <br />applicable law; and <br />WHEREAS, the State, on the 7th day of September, 1977, entered <br />into an agreement with the United States of America, by and through the <br />Corps of Engineers to acquire the lands and interest therein for that <br />portion of the Project described as Reach One necessary for flood <br />control purposes in lieu of the authorized channel improvements; and <br />. <br /> <br />WHEREAS, this agreement supersedes and rescinds any and all prior <br />agreements and assurances that the parties to this agreement have <br />previously entered into in regards to the subject matter of this agree- <br /> <br />ment. <br /> <br />NOW, THEREFORE, the parties agree as follows: <br />1. The City agrees that it shall fulfill the requirements of non- <br />Federal cooperation, to-wit: <br />a.
