<br />.' <br /> <br />. <br /> <br />LOCAL REOUEST FOR DESIGNATION <br /> <br />WHEREAS, the Urban Drainage and Flood Control District (District) requested CWCB <br />designation and approval of said new report, by letter dated July 2, 2003, for the studied streams <br />contained in said new report dated May 2003 within Douglas County; and <br /> <br />WHEREAS, Douglas County transmitted a request letter to the CWCB and the District has <br />coordinated closely with all of the entities affected by the floodplain information contained in said <br />new report; and <br /> <br />WHEREAS, CWCB staff notified the Urban Drainage and Flood Control District via telephone <br />and email of the designation action as requested; and <br /> <br />C.R.S. AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />. WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />CONSISTENCY WITH PREVIOUS FLOODPLAIN STUDIES <br /> <br />WHEREAS, the detailed floodplain information for the studied reaches contained in said new <br />report dated May 2003 for the Cherry Creek watershed revises and is, therefore, inconsistent with the <br />previously published floodplain information for the same stream reaches as studied approximate and/or <br />detailed methods; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHERAS, the watershed above Cherry Creek reservoir is 386 square miles and includes <br />portions of Arapahoe, Douglas and El Paso Counties; and <br /> <br />WHEREAS, the lower portions of the study reach are highly developed in certain areas and <br />contain infrastructure, residential development, and commercial development; and <br /> <br />WHEREAS, a number of significant flood events have been documented along Cherry <br />Creek during recorded history within the region; and <br /> <br />. <br /> <br />2 <br />
